applicant shall not be required to reestablish the buffer area to meet the standards contained in ibis Section. Subd. 5. Responsibilities of Subsequent Lot Purchasers. Subsequent purchasers of Tots subject to this Section are not required to engage in active maintenance of buffers. Itowever, it remains the responsibility of lot purchasers to refrain from activities prohibited within wetland buffers as enunciated in this subdivision and in the required notice recorded against the lot title. Some otherwise prohibited activities, such as mowing or herbicide applications, may be allowed as elements of an active maintenance plan approved by City staff. The lbllowing activities are prohibited within wetland buffers unless expressly allowed under a City-approved buffer management regimen: a. Mowing; Cutting of woody vegetation, with the exception of invasive non-native trees and shrubs, shall be prohibited. A list of invasive non-native trees and shrubs is available from the City; c. Filling, grading or excavating; d. Disposal of grass clippings, tree branches or other vegetative waste; c. Placement of structures; Application of herbicides, except as applied in spot treatments to control or eradicate prohibited, restricted or secondary noxious weeds as defined in Minn. Rules 1505.0730 to 1505.750. A list of these species is available fi-om the City. 9.26. I 0 Encroachment in Buffer Areas. Storm water ponds may encroach into required wetland buffer areas, provided it doesn't reduce the buffer's ability to treat storm water and that Iht amount of buffer width encroached upon does not exceed 50 percent of the total area required /'or such ponding. SECTION 2. SUMMARY The l¥11owing official summary of Ordinance #05-__ has been approved by the City Council of thc City ol'Ramsey as clearly informing the public of the intent and effect of the Ordinance. It is the intent and effect of Ordinance #05- to amend Ramsey City Code Chapter 9 (Zoning and Subdivision of Land) to add a section to establish regulations and guidelines that will provide standards for wetland protection within the City and consistent with the requirements of Minnesota Statutes. SECTION 3. EFFECTIVE DATE 'l'he effective date of this ordinance is thirty (30) days after its passage and publication, subject to (;ity Charter Section 5.07.
