applicant shall not be required to reestablish the buffer area to meet the standards contained in <br />ibis Section. <br /> <br /> Subd. 5. Responsibilities of Subsequent Lot Purchasers. Subsequent <br />purchasers of Tots subject to this Section are not required to engage in active maintenance of <br />buffers. Itowever, it remains the responsibility of lot purchasers to refrain from activities <br />prohibited within wetland buffers as enunciated in this subdivision and in the required notice <br />recorded against the lot title. Some otherwise prohibited activities, such as mowing or herbicide <br />applications, may be allowed as elements of an active maintenance plan approved by City staff. <br />The lbllowing activities are prohibited within wetland buffers unless expressly allowed under a <br />City-approved buffer management regimen: <br /> <br />a. Mowing; <br /> <br />Cutting of woody vegetation, with the exception of invasive non-native <br />trees and shrubs, shall be prohibited. A list of invasive non-native trees <br />and shrubs is available from the City; <br /> <br />c. Filling, grading or excavating; <br /> <br />d. Disposal of grass clippings, tree branches or other vegetative waste; <br /> <br />c. Placement of structures; <br /> <br />Application of herbicides, except as applied in spot treatments to control <br />or eradicate prohibited, restricted or secondary noxious weeds as defined <br />in Minn. Rules 1505.0730 to 1505.750. A list of these species is available <br />fi-om the City. <br /> <br />9.26. I 0 Encroachment in Buffer Areas. Storm water ponds may encroach into required <br />wetland buffer areas, provided it doesn't reduce the buffer's ability to treat storm water and that <br />Iht amount of buffer width encroached upon does not exceed 50 percent of the total area required <br />/'or such ponding. <br /> <br />SECTION 2. SUMMARY <br /> <br />The l¥11owing official summary of Ordinance #05-__ has been approved by the City Council of <br />thc City ol'Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br /> <br />It is the intent and effect of Ordinance #05- to amend Ramsey City Code Chapter 9 (Zoning <br />and Subdivision of Land) to add a section to establish regulations and guidelines that will <br />provide standards for wetland protection within the City and consistent with the requirements of <br />Minnesota Statutes. <br /> <br />SECTION 3. EFFECTIVE DATE <br /> <br />'l'he effective date of this ordinance is thirty (30) days after its passage and publication, subject to <br />(;ity Charter Section 5.07. <br /> <br /> <br />
