Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #22-017 <br />RESOLUTION APPROVING RIVERSTONE OUTLOT OWNERSHIP <br />WHEREAS, Riverstone Development LLC, hereafter referred to as "Developer", properly <br />received Preliminary Plat and subsequent Final Plat approvals for a development known as Riverstone; <br />and <br />WHEREAS, the development platted various outlots; and <br />WHEREAS, the Developer maintains ownership of some outlots; and <br />WHEREAS, the City has historically been provided drainage and utility easements over <br />necessary outlots with ownership of the outlots being privately owned; and <br />WHEREAS, the development has an active Homeowners Association; and <br />WHEREAS, staff reviewed documents related to the implementation of the Homeowners <br />Association, but the documents did not identify the Homeowners Association to maintain ownership <br />of all outlots; and <br />outlots: <br />WHEREAS, the Developer has requested the City of Ramsey take ownership of the following <br />• Riverstone, Outlot D <br />• Riverstone 4th, Outlots E, G, H <br />• Riverstone 5th, Outlots A, B <br />WHEREAS, staff recognizes a public purpose for the above reference outlots with no benefit <br />to the Developer; and <br />WHEREAS, staff recommends the following condition to accept ownership of the above <br />referenced outlots: <br />• The Developer pay in full any outstanding taxes owed <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, COUNTY OF ANOKA, STATE OF MINNESOTA, as follows: <br />1) That the City Council of Ramsey hereby approves, subject to conditions identified in <br />paragraph 2, the ownership of the following outlots in the Riverstone development: <br />• Riverstone, Outlot D <br />• Riverstone 4`h, Outlots E, G, H <br />• Riverstone 5`h, Outlots, A, B <br />2) Conditions of ownership of the above referenced outlots as follows: <br />
