Councilmember Heineman introduced the following resolution and moved for its adoption: <br /> RESOLUTION #22-047 <br /> RESOLUTION APPROVING A DRIVEWAY AGREEMENT IN AN EASEMENT ON <br /> THE PROPERTY GENERALLY KNOWN AS 15730 ARMSTRONG BLVD NW AND <br /> DECLARING TERMS OF SAME <br /> WHEREAS, Eduard Kopaygorodskiy, hereinafter referred to as the "Applicant," has <br /> requested a Driveway Agreement to install a driveway across a drainage and utility easement(the <br /> "Easement") that runs north/south through the central portion of the property generally known as <br /> 15730 Armstrong Boulevard NW and legally described as follows: <br /> LOT 2, BLOCK 1 NORDVIK ADDITION, Anoka County, Minnesota <br /> (the "Subject Property"). <br /> WHEREAS,the Applicant is preparing to apply for a Building Permit for a single-family <br /> dwelling on the Subject Property; and <br /> WHEREAS, the Easement was secured as part of the Nordvik Addition plat for the <br /> purpose of reserving a corridor for the future southerly extension of Eland Street; and <br /> WHEREAS, the Applicant is requesting to extend a driveway from an existing curb-cut <br /> on Armstrong Boulevard across the Easement to a proposed building site for a single-family home; <br /> and <br /> WHEREAS, the Development Agreement for Nordvik Addition states that the Subject <br /> Property shall be allowed access onto Armstrong Boulevard NW, until such time that either Lot 1 <br /> and/or 2, Block 1 Nordvik Addition is further subdivided, which would require construction of <br /> interior road(s)to provide access to the resulting new lots; and <br /> WHEREAS, the City Council reviewed the Driveway Agreement on February 22, 2022. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1. That the Applicant can install the driveway within the Easement contingent upon: <br /> a) The Applicant entering into a Driveway Agreement with the City and recording said <br /> agreement against the Subject Property; and <br /> b) Review and approval of the Driveway Agreement by the City Engineer to ensure the <br /> Easement can still function as intended; and <br /> c) The driveway must connect to the existing curb cut on Armstrong Blvd NW. <br />
