Councilmember Riley introduced the following resolution and moved for its adoption: RESOLUTION #22-036 RESOLUTION GRANTING FINAL PLAT APPROVAL OF RILES RUM RIVER ACRES WHEREAS, Mark Rice, hereafter referred to as "Applicant", properly applied for Sketch Plan and Final Plat approval of the following described property located in the City of Ramsey: Lots 11 and 12, Block 6, Barthel's Rum River Acres 2nd Addition, Anoka County, Minnesota Or upon platting: Lot 1, Block 1, Rices Rum River Acres, Anoka County, Minnesota (the `Subject Property'); and WHEREAS, the Applicant is proposing a future accessory structure that would encroach into the Scenic Easement on the Subject Property; and WHEREAS, on February 22, 2022, the City Council introduced Ordinance 422-13 vacating drainage and utility easements on the Subject Property; and WHEREAS, on February 22, 2022, the City Council reviewed the location of a proposed detached accessory structure and the Final Plat of Rices Rum River Acres. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council hereby grants final plat approval of Rices Rum River Acres in accordance with relevant City Codes, subject to the following conditions: a) Approval by the City Engineer; and b) Final Plat subject to review and approval as to legal form by the City Attorney; and c) Adoption of Ordinance 22-13 vacating all existing drainage and utility easements on the Subject Property (note that drainage and utility easements are rededicated with the Final Plat); and d) Approval of a Variance to the OHW setback requirement. 2) That the Ramsey City Council hereby authorizes the construction of a detached accessory building partially within the Scenic Easement on the Subject Property as shown in the attached Exhibit.
