CC Regular Session 5. 22. <br /> Meeting Date: 12/14/2021 <br /> Submitted For: Chloe McGuire Brigl, Community Development <br /> By: Brian McCann, Community Development <br /> Information <br /> Title <br /> Adopt Resolutions#21-343 and#21-346 Approving Park Maintenance Agreement and Accepting Outlot C for <br /> Riverstone <br /> Purpose/Background: <br /> The purpose of this case is to approve a park maintenance agreement for City-owned Outlot C of the Riverstone <br /> development,known as Pearson Park. The agreement includes City responsibilities of maintaining,repairing, and <br /> necessary improvements of the park; all other maintenance responsibilities will be provided by the Riverstone <br /> Home Owner's Association(HOA). <br /> It may be noted here,that requiring the HOA to be perpetually responsible for certain park maintenance was a <br /> condition of the original Development Agreement and was intended to limit maintenance costs city-wide, for park <br /> improvements that primarily benefited the Developer and new residents of the Riverstone subdivision. Of further <br /> note,Park Dedication land credit was not calculated for the approximate one acre parcel(Outlot C), and the full <br /> cash Park Dedication per-unit amount was collected for the construction of Pearson Park, and for the future <br /> development of Lake Itasca Park on the north side of Alpine Drive. <br /> Notification: <br /> No notification is required for this step. <br /> Observations/Alternatives: <br /> Park Maintenance Agreement <br /> Exhibit B on the attached Park Maintenance Agreement shows the maintenance areas,what they include, and <br /> whose responsibility they are(HOA or City). Based on the exhibit,HOA responsibilities are: <br /> .Dormant mowing on the north/west sides of the park(once every year); <br /> . Small areas of irrigated turf grass on the northeast and southwest(maintained as needed); and <br /> .Low grow native grasses (twice per summer). <br /> City responsibilities include: <br /> •Perimeter of the wood chip zones central to the park including the play equipment(as needed); and <br /> .Dwarf Bush Honeysuckle(as needed). <br /> Descriptions of the required maintenance of these areas can be found on the last two(2)pages of the Park <br /> Maintenance Agreement. The Warranty Deed for Outlot C for the park is attached to this case. <br /> Funding Source: <br /> The Applicant is responsible for all costs associated with project review and approvals. <br /> Recommendation: <br /> Staff recommends the City Council adopt Resolutions#21-343 and#21-346 <br /> Action: <br />
