Councilmember introduced the following resolution and moved for its adoption: <br /> RESOLUTION #21-343 <br /> RESOLUTION APPROVING A PARK MAINTENANCE AGREEMENT RIVERSTONE <br /> WHERAS the Riverstone Homeowners' Association, hereinafter referred to as the <br /> "Applicant"has received approval for Pearson Park(the"Park") on the property legally described <br /> as follows: <br /> Outlot C, Riverstone, Anoka County, Minnesota <br /> ("Subject Property"); and <br /> WHERAS the Applicant has completed public park improvements as outlined in the <br /> preliminary plat resolution for Riverstone, and is deeding the Park to the City. <br /> WHEREAS the City Council reviewed and approved the agreement on December 14, 2021. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA <br /> COUNTY, STATE OF MINNESOTA, as follows: <br /> That the City Council hereby grants approval of the Park Maintenance Agreement Riverstone, <br /> contingent upon the following conditions: <br /> CONDITIONS <br /> 1. Final legal form approved by the City Attorney; and <br /> 2. Approval of the maintenance agreement prior to accepting the deed of Outlot C (Pearson <br /> Park) for park improvements; and <br /> 3. The Applicant shall be responsible for all City costs incurred in administering and <br /> enforcing this Agreement; and <br /> 4. The Applicant shall deed the property to the City prior to recording of this document; and <br /> 5. The Agreement shall be recorded against the Subject Property at the cost of the Applicant. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br /> and the following voted against the same: <br /> and the following abstained: <br /> and the following were absent: <br />
