City Attorney Knaak stated if the question is that three members of the Charter Commission are <br /> also Board members other than Councilmembers, yes, someone who is in violation of the Charter <br /> would have to resign. <br /> Councilmember Musgrove asked if this goes to the Charter Commission, would they vote for <br /> themselves to be off the Charter Commission. <br /> City Administrator Ulrich commented that the vote at the Charter Commission doesn't need to be <br /> a unanimous vote. <br /> City Attorney Knaak agreed that it does not. <br /> City Administrator Ulrich commented it needs to be a majority vote and it is a nine member body. <br /> Councilmember Woestehoff asked about the process and if it was best for the Council to draft the <br /> ordinance, then it goes to the Charter, and then it comes back to the Council. <br /> City Attorney Knaak confirmed this. <br /> 2.05: Discuss Referendum for Proposed Charter Amendment <br /> Councilmember Woestehoff asked if there was another route that would lead to a referendum on <br /> a vote. <br /> City Attorney Knaak confirmed this. <br /> Councilmember Woestehoff asked for City Attorney Knaak to explain those. <br /> City Attorney Knaak asked if consensus is that they want language that states a member of a <br /> Commission or Board cannot also serve on the Charter Commission. He explained that in looking <br /> at a Charter Amendment, the second part of the case, that says the Charter can be modified in a <br /> way in which the Charter Commission proposes an ordinance with a majority and then the Council <br /> considers and passes it unanimously and it becomes part of the Charter. Another way is to go to <br /> the voters. <br /> Councilmember Howell asked if they send it to the Charter Commission, they have 60 days and <br /> can ask for another 90-day extension. <br /> City Attorney Knaak replied yes, that's if the ordinance is passed. <br /> Councilmember Howell asked what happens in 150 days if there aren't people sitting on the <br /> Council who want to make that separation of powers.
