PUBLIC HEARINGS/BOARD BUSINESS

Case #1:

Request for a Variance to the Impervious Surface Restrictions in the Wild
and Scenic River Overlay District; Case of Suntide Commercial Realty

The Wild and Scenic River Overlay District has a 30% impervious surface restriction. Assistant
Community Development Director Frolik advised that Suntide Commercial Realty, Inc. has
applied for a variance to the impervious surface restrictions. She stated that Rivers Bend Plaza
currently has an impervious surface calculation of 71%, and is considered legal non-conforming.

Assistant Community Development Director Frolik stated that Tanners Tavern and Grill will be
moving into the northern end unit of the multi-tenant building. She indicated that adjacent to this
unit is a grassy area that had at one time been used as a play area for a previous tenant. She
stated the proposed improvements would replace this turfed area with an outdoor dining patio
and additional customer parking, increasing the impervious surface calculation to 75%.

Assistant Community Development Director Frolik advised that a portion of the storm water
runoff from this property flows into catch basins located on the common property line with Blue
Velvet Carwash and then to a regional treatment pond located in Rivers Bend Park. She stated
that the southerly portion of the property flows eastward along the ditch line of TH 47 and then
into a storm sewer discharging into the Rum River. She indicated that there are two existing
stormwater discharge routes that provide some level of storm water treatment prior to ultimate
discharge into the river. She stated that the additional pavement transmits an increased volume
of water to the river at a quicker rate than the present condition. She indicated that Staff has
therefore asked the applicant to explore the possibility of including some on-site ponding or
additional landscape plan}ings to reduce the rate of storm drainage to the river.

Public Hearing

Chairperson Nixt opened the public hearing at 7:04 p.m.

There were no citizen comments.

Motion by Chairperson Nixt, seconded by Board Member Johnson to close the public hearing at
7:04 p.m.

Motion c'arried.
