CASE <br /> <br /> PUBLIC HEARING <br />REQUEST FOR A VARIANCE TO THE FRONT YARD SETBACK REQUIREMENTS <br />IN THE R-I RESIDENTIAL DISTRICT FOR SWEETBAY RIDGE; <br /> CASE OF OAKWOOD DEVELOPMENT, INC. <br /> By: Sylvia Frolik, Asst. Community Development Director <br /> <br />Background: <br /> <br />Oakwood Development is proposing to plat and develop Sweetbay Ridge, land formerly known <br />as the St. Anthony Gun Club generally located east of Variolite Street at 161st Avenue N.W. City <br />Code establishes a 30 foot front yard setback from public street right-of-way in the R-1 <br />Residential' District. The applicant has designed the plat with a 25 foot front yard setback on 56 <br />o f the 158 lots. <br /> <br />The fi~llowing items are enclosed for your information: <br /> <br />a) Site location map <br />b) Preliminary Plat version dated August 2., 2005 <br />c) Proposed Findings of Fact <br />d) 'Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff sent notification of the request for a variance to property <br />owners within 700 feet of the subject property. <br /> <br />Observations: <br /> <br />The area of the plat contains significant wetland and tree cover. The design of some of the lots <br />with a 25 tbot setback was an effort to achieve the following: <br /> <br />Maintain the minimum right-of-way width required for public roads. <br />Minimize wetland filling' <br />Minimize tree removal <br />Increase wetland buffer widths <br /> <br />Staff Recommendation: <br /> <br />City Stat'f' recommends approval of the variance. <br /> <br /> <br />
