CASE # <br /> <br />CONSIDER ORDINANCE TO AMEND SECTION 9.11 <br />(PERFORMANCE STANDARDS) OF CITY CODE; <br />CASE OF CITY OF RAMSEY <br /> By: Chris Anderson, Zoning & Recycling Coordinator <br /> <br />Background: <br /> <br />F~arlicr this year, the City received a building permit application for an exterior solid fuel-fired <br />heating device (outdoor furnace). During the review process of this application, City Staff <br />realized that there are no standards or regulations for these appliances in City Code. Due to their <br />potential to create a nuisance for neighboring properties, City Staff has drafted an ordinance to <br />establish some basic regulations for these devices. <br /> <br />'['he fi)llowing items are enclosed for review: <br /> a) Revised draft ordinance showing deletions and additions <br /> b) "Clean" revised draft ordinance <br /> c) Draft Planning Commission meeting minutes dated September 1, 2005 <br /> <br />Observations: <br /> <br />The proposed code amendment would establish minimum standards for exterior solid fuel-fired <br />heating devices including both a minimum setback from property lines and installation <br />requirements. These requirements aim to minimize the potential nuisances created by these <br />appliances such as smoke ancL/or cinders. <br /> <br />At thc September 1, 2005 Planning Commission meeting, City Staff presented a draft ordinance <br />regarding exterior solid fuel-fired heating devices. After some discussion, Staff was directed to <br />make some revisions to the proposed regulations and bring the draft ordinance back to the <br />Planning Commission for review. <br /> <br />The lbllowing is a summary of the revisions that have been made: <br /> <br />· Thc word "outdoor" has been replaced with the word "exterior" to eliminate any <br /> connotation that these are recreational devices; <br />· The definition now specifies that this is an external device used to produce heat for the <br /> interior of building; <br />· The definition of public nuisance has been revised to conform with other Sections of City <br /> Code; <br />· The definition of stacks and chimneys has been deleted, as there is no reference to these <br /> within the text of the ordinance; <br />· A minimum property size required to install a solid fuel-fired heating device has been <br /> eliminated, however, the setback from any property line has been increased from fifty <br /> (5(1) feet to seventy-five (75) feet.
