Accessory Structure <br />for a Legal, Non-Conforming Use; Case of George and Frances Cowles <br /> <br />Presentation <br /> <br />Associate Planner Dalnes advised that this is a request for a conditional use permit to construct <br />an accessory structure for a legal, non-conforming use, located at 9537 Highway I0. She stated <br />the subject property is approximately 1 acre in size and is zoned B-2 Business District. She. <br />indicated the proposal seeks to expand the legal, non-conforming use by constructing a garage as <br />an accessory use to a private residence located on the property. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt opened the public hearing at 7:30 p.m. <br /> <br />Motion by Chairperson Nixt, seconded by Cormnissioner Van Scoy to close the public hearing at <br />7:30 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Van Scoy, Brauer, Shepherd, <br />and Watson. Voting No: None. Absent: Commissioners Johnson and Levine. <br /> <br />Commission Business <br /> <br />Associate Planner Dalnes noted that this property is outside the area designated for future <br />Highway #10 improvements. <br /> <br />Chairperson Nixt stated he is in favor of this because it promotes organization of the property. <br /> <br />Chairperson Nixt asked if this .would beone overhead door. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Watson to recommend the City <br />Council adopt Findings of Fact relating to George and Frances Cowles' request for a conditional <br />use permit to build an accessory structure for the legal, non-confon'ning residence on the property <br />at 9537 Highway 10, favorable to the applicant. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Watson, Brauer, Shepherd, and <br />Van Scoy. Voting No: None. Absent: Commissioners Johnson and Levine. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy to recommend that City <br />Council approve George and France's Cowles' request for a conditional use permit to add an <br />accessory structure for the legal, non-conforming residence based on the findings of fact, and <br />adopt a resolution declaring terms of same. <br /> <br />Planning Commission/September 1, 2005 <br /> Page 6 of 16 <br /> <br /> <br />
