Chairperson Cook clarified that the purpose of these points in the Development Agreement is to <br />show that On'in Thompson would not be responsible for the maintenance. <br /> <br />Parks/Utilities Supervisor Boos said the purpose was to suggest that the City would provide the <br />maintenance, and to call attention to anything the developer had that would need maintenance. <br /> <br />Motion by Commissioner Johns, seconded by Commissioner Olds to accept the Park Dedication <br />and tree maintenance to be enacted pursuant to the Draft Development Agreement for Birch Hill <br />Lodges as written on page 2 of the Agenda. <br /> <br />Motion carried. Voting Yes: Chairperson Cook, Commissioners Johns, Olds, and Rolfe. Voting <br />No: None. Absent: Commissioners LaMere and Ostrum. <br /> <br />Case #2: Approve Development Agreement for Highlands at River Park <br /> <br />Parks/Utilities Supervisor Boos explained that the purpose of this case is to recommend approval <br />of the Park Dedication and Trail Fee portion of the Highlands at River Park (a.k.a. Centex <br />Addition) Development Agreement. As the Commission will recall, the developer brought a <br />concept plan for the "Centex Addition" to the May 2001 regular meeting for planning direction. <br />Later, after neighborhood meetings and at the time of sketch plan approval by the Planning <br />Commission, the recommendations by the Park Commission were refined with respect to the <br />land to be dedicated and the priority and phasing of improvements that were to occur. <br /> <br />Parks/Utilities Supervisor Boos mentioned that 157 single-family homes north of Alpine Drive, <br />west of Bear Park, and east of Woodland Green Park will be built. Only 13 lots are platted for <br />this first phase. For this reason, the development agreement that will be handed out is different <br />than when the entire subdivision was considered, and is different than what is included in the <br />agenda. Centex is only purchasing the land that the first phase will be built upon. They cannot <br />dedicate the land at this point. <br /> <br />Chairperson Cook commented that they should be able to phase the park land in as they build. <br /> <br />Parks/Utilities Supervisor Boos noted that items a) through f) on the second page of the handout <br />list the priorities as ranked by the Commission this summer. The $35,000 to $45,000 play <br />structure this plan calls for greatly exceeds the park dedication due. This is an aggressive <br />development agreement. He also explained that because construction will probably take place <br />next spring, the trail paving costs may not be known. Staff is agreeable to obtaining bids at that <br />time rather than locking in the proposed costs in the agreement in the packet. He indicated the <br />trail would still be from T.H. #47 to Roanoke Street. The land dedication would be consistent <br />with the preliminary plat. <br /> <br />Chairperson Cook said that this developer was sensitive to the residents of this area and was <br />making this fit into this community. <br /> <br />Park and Recreation Commission/December 13, 2001 <br /> Page 3 of 10 <br /> <br /> <br />
