3. That the Permittee agrees to construct the Building in the location shown in Exhibit 1. <br />4. That this Variance shall be perpetual in duration as long as the terms are herein complied <br />with. <br />5. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Variance. <br />6. That the Permittee shall obtain all necessary permits prior to commencing any <br />construction of the Building, including a Building Permit. <br />7. That the City Administrator, or his/her designee, shall have the right to inspect the Subject <br />Property, for compliance and safety purposes annually or at any time, upon reasonable <br />request. <br />8. That this Variance shall automatically expire if the use is not initiated by March 24, 2023, <br />and issuance of the Building Permit for the Building shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />VanScoy, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Bauer <br />Commissioner Gengler <br />Commissioner VanScoy <br />Commissioner Anderson <br />Commissioner Peters <br />Commissioner Walker <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />Existing Vacancy <br />whereupon said resolution was declared duly passed and adopted by the Ramsey Planning <br />Commission this the 24th day of March, 2022. <br />RESOLUTION #22-066 <br />Page 3 of 5 <br />
