Councilmember Musgrove introduced the following resolution and moved for its adoption: <br /> RESOLUTION#22-081 <br /> RESOLUTION APPROVING A SCRIVENER'S AFFIDAVIT CORRECTING A <br /> TYPOGRAPHICAL ERROR IN A LEGAL DESCRIPTION OF A DRAINAGE AND <br /> UTILITY EASEMENT ORIGINALLY ESTABLISHED ON OUTLOT A, RIVENWICK <br /> VILLAGE AND STILL ENCUMBERING A PORTION OF OUTLOT A, RIVENWICK <br /> VILLAGE 3RD ADDITION <br /> RECITALS <br /> 1. In 2005, Denali Investments LLC deeded to the City of Ramsey a perpetual easement for <br /> drainage and utility purposes over, under, and across a portion of Outlot A, Rivenwick <br /> Village, as outlined in Document No. 1977693.001; and <br /> 2. That a typographical error in the legal description within Document No. 1977693.001 has <br /> been discovered; and <br /> 3. That since it is a simple typographical error and that the intent of the easement is still clear, <br /> a Scrivener's Affidavit can be filed to correct said typographical error. <br /> NOW THEREFORE,BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1) That the Ramsey City Council hereby grants approval the Scrivener's Affidavit to correct <br /> a typographical error in the legal description of a perpetual easement for drainage and <br /> utility purposes within Document No. 1977693.001 and directs Staff to file said affidavit <br /> with Anoka County. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> Howell, and upon vote being taken thereon, the following voted in favor thereof: <br /> Mayor Kuzma <br /> Councilmember Musgrove <br /> Councilmember Howell <br /> Councilmember Heineman <br /> Councilmember Riley <br /> Councilmember Specht <br /> Councilmember Woestehoff <br /> and the following voted against the same: <br /> None <br />
