Amended Conditional Use Permit for Green Valley <br /> Greenhouse; Case of John Rowe <br /> <br />Presentation <br /> <br />Assistant Community Development Director Frolik stated that Green Valley Greenhouse Was in <br />operation as a lawful non-conforming use from 1977 to 1990. She indicated that in 1990, the <br />City Council issued a Conditional Use Permit for an expansion of the ~eenhouse facility. She <br />stated that that pen-nit was amended again in 2000 and 2004 for expansion plans. She indicated <br />that the 2004 amendment process looked at a six year groxvth plan for the bus/ness and an <br />'ultimate development area' was established. <br /> <br />Assistant Community Development Director Frolik stated that in 2005, Green Valley <br />Greenhouse also began stocking and selling bulk landscape materials, such as soil, gavel, and <br />rock. She indicated that City Staff notified Mr. Rowe that the addition of a sales area to expand <br />the facility to now include sale of bulk landscape materials is not covered under the current <br />Conditional Use Permit. She indicated that consequently, Mr. Rowe did apply for an amended <br />Conditional Use Permit. <br /> <br />Chairperson Nixt clarified that the nursery has a conditional use permit, and there is nothing in <br />the City's Ordinance that defines a nursery, but Staff feels this is inconsistent with what a <br />nursery should be. Chairperson Nixt noted that he does not see a restriction on this kind of use in <br />the terms of the conditional use permit-. <br /> <br />Assistant Community Development Director Frolik stated that Staff feels it is inconsistent with <br />the 6 year business plan established in the Conditional Use Permit amendment of 2004. That <br />plan addressed expansion of the offices, warehouse, and nurseries for additional growing area. <br />The plan addressed the needs of the nursery as it relates to growing their inventory; it did not <br />address importing landscape materials to be sold from the property. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt opened the public hearing at 7:10 p.m. <br /> <br />-22- <br /> <br />Planning Commission/September 1, 2005 <br /> Page 2 of 1.5 <br /> <br /> <br />
