Mayor Gamec indicated Mr. Look's concern that this assessment be included in the general fund
budget has been noted.

Mr. Look stated his only other option would be to change the charter.

City Engineer Jankowski indicated the City received a letter from Jennifer Asmussen, 15029
Iqelium Street NW regarding Project 05-02. He explained this is a unique area that does not have
sewer and water, but is divided into sewer and water sized lots. Ms. Asmussen makes the
~bllowing points:
[tern No. I: Ms. Asmussen states there are still holes in the road that have not been
repaired. He stated he personally inspected the street this afternoon, and the only hole he
~'ound was two inches wide by six inches long by V2 inch deep. This is the only defect he
could find in the sealcoat.
[tern Nos. 2 and 3: He will not comment on these items unless, requested by the Council.
[tern No. 4: Ms. Asmussen indicates that some of the residents in the subdivision have
combined their lots and made the lot line disappear, so where some had three lots they
now have two lots. He explained the lot line did not disappear; these property owners did
a lot combination with an assigned tax number. As a result, there are two residents in the
subdivision that are only being assessed for two units, and the remaining six are being
assessed for three units. He was unaware of this until it was brought to his attention in
this letter. One possible remedy would be to double assess the lots that have been
combined, which would likely be more equitable. 'This would require a notification to.
these property owners that the assessment would be double, as they were notified of the
single assessment amount.

,Mayor Gamec commented it had been stated if the lots were combined there..would only be one
assessment, as they are calculated by the square footage. He directed staff to inform Ms.
Asmussen about the reason for the lot combinations and that she would be able to complete a
combination for the case of future assessments. He indicated the letter from Ms. Asmussen will
be entered into the record, marked "Exhibit A".

Motion by Councilmember Olson, seconded by Councilmember Cook, to close the public
hearing.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Olson, Cook, ENig, Olson,
Pearsoa, and Strommen. Voting No: None. Absent: Councilmember Jeffrey.

The public hearing was closed at 7:37 p.m.

Council Business

Mayor Gamec called the regular City Council meeting back to order at 7:37 p.m.

Com~.cilmember Elvig indicated he received three phone calls from residents in the area of 160th
Avenue with questions about the quality of the sealcoat. He would like to be sure that the City is

City Council / September 27, 2005

-50-
