BI,lC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to the Impervious Surface Restrictions in the Wild <br />and Scenic River Overlay District; Case of Suntide Commercial Realty <br /> <br />The Wild and Scenic River Overlay District has a 30% impervious surface restriction. Assistant <br />Colnmunity Development Director Frolik advised that Suntide Commercial Realty, Inc. has <br />applied lbr a variance to the impervious surface restrictions. She stated that Rivers Bend Plaza <br />cm'vcntly has an impervious surface calculation of 71%, and is considered legal non-conforming. <br /> <br />Assistant Community Development Director Frolik stated that Tanners Tavern and Grill will be <br />moving into the northern end unit of the multi-tenant building. She indicated that adjacent to this <br />unit is a grassy area that had at one time been used as a play area for a previous tenant. She <br />stated thc proposed improvements would replace this turfed area with an outdoor dining patio <br />~md additional customer parking, increasing the impervious surface calculation to 75%. <br /> <br />Assistant Community Development Director Frolik advised that a portion of the storm water <br />runoff fi'om this property flows into catch basins located on the common property line with Blue <br />Vclvct Carwash and then to a regional treatment pond located in Rivers Bend Park. She stated <br />i. hat the southerly portion of the property flows eastward along the ditch line of TH 47 and then <br />into a storm sewer discharging into the Rum River. She indicated that there are two existing <br />stormwatcr discharge routes that provide some level of storm water treatment prior to ultimate <br />discharge into the river. She stated that the additional pavement transmits an increased volume <br />,~)l' watcr to the river at a quicker rate than the present condition. She indicated that Staff has <br />thcrclbrc asked the applicant to explore the possibility of including some on-site ponding or <br />;:tdditional landscape plantings to reduce the rate of storm drainage to the river. <br /> <br />Public Hearing <br /> <br />Cbairpcrson Nixt opened the public hearing at 7:04 p.m. <br /> <br />There were no citizen comments. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Johnson to close the public hearing at <br />7:04 p.m, <br /> <br />Motion carricd. Voting Yes: Chairperson Nixt, Board Members Johnson, Levine, Shepherd, and <br />V~m Scoy. Voting No: None. Absent: Board Members Brauer and Watson. <br /> <br />Board Business <br /> <br />Motion by Board Member Johnson, seconded by Chairperson Nixt to adopt Resolution #05-08- <br />256 adopting Findings of Fact #0733 relating to a request for a variance to impervious surface <br />restrictions in the Wild and Scenic River Overlay District to facilitate additional customer <br />parking and outdoor dining patio at the Rivers Bend Plaza. <br /> <br />Board of Adjustment/August 8, 2005 <br /> Page 2 of 4 <br /> <br /> <br />
