CASE # <br /> <br />REQUEST FOR A VARIANCE TO ACCESSORY STRUCTURE SETBACK <br />REQUIREMENTS; CASE OF MIKE AND ANITA KUCALA <br /> By: Community Development Intern Alex Blackburn <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. Michael and Anita Kucala are requesting a variance to construct a <br />garage nearer the front property line than the principal structure at 15541 Zirconium Street N.W. <br />The parcel is approximately 4.5 acres in size, and the house is located approximately 234 feet <br />from the nearest point of the property line. Mr. Kucala is proposing to construct a garage, which <br />will be approximately 210 feet from the nearest point of the property line. The following items <br />are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan (2 sheets) <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />subject property of the request for a variance. <br /> <br />Observations: <br />The site plan submitted and an on-site inspection reveal that the property is significantly covered <br />by mature tree growth, and some wetlands and declining topography. These features prohibit <br />construction of a garage in the side or rear yard. In Staff's opinion, the mature tree growth in the <br />area and the alignment of neighboring homes around the street are such that there should be no <br />adverse impact to the neighbors view of the street scape by the construction of this proposed <br />garage. The attached garage located on the principal structure is 24 x 23. <br /> <br />Staff Recommendation: <br /> <br />In the opinion of City Staff, the physical features on Mr. Kucala's property justify the granting of <br />a variance.
