City Attorney Knaak replied personnel issues, anything that could involve litigation, even sensitive <br /> matters that would ordinarily require a lawyer to give confidential advice or hear confidential <br /> information from a client. He stated it was one of the least clearly defined exceptions. He stated <br /> it wasn't something that should be used unless there is some kind of serious issue related to <br /> personnel, pending litigation, or real estate purchases. <br /> Mayor Pro Tem Riley asked if it needs to be noticed. <br /> City Attorney Knaak confirmed this, adding unless it is an emergency, in which case it has be to <br /> published as an emergency and he wasn't sure if this would necessarily qualify. <br /> Councilmember Musgrove asked if just the Council meets with the attorney to get advice, is that <br /> considered a Closed Session meeting. <br /> City Attorney Knaak replied no. <br /> Councilmember Musgrove asked if they would do that after the City Council meeting. <br /> City Attorney Knaak confirmed this. He stated the danger of that is if it is thought that this could <br /> involve some sort of dispute, if it is on the record, they may end up waiving the attorney/client <br /> privilege so it is nice to know what will be discussed. <br /> Councilmember Musgrove replied she and City Attorney Knaak had a conversation on the <br /> weekend about it. <br /> City Attorney Knaak replied he didn't know that it would be something that would require <br /> attorney/client privilege or could be closed. <br /> Councilmember Howell asked if the employee has the right to open the meeting. <br /> City Attorney Knaak replied, yes if about the employee. <br /> Councilmember Musgrove replied that is fine.
