CASE #: / <br /> <br />REQUEST FOR A VARIANCE TO LANDSCAPE REQUIREMENTS; <br />CASE OF RF DEVELOPMENT AND LYNDALE TERMINAL COMPANY <br />By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Rick Foster of RF Development and Victor Sacco of Lyndale Terminal Company have submitted <br />a request for variance to the landscape requirements adjacent to public roads. The following <br />items are enclosed: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site plan <br />Excerpt from 1980 agreement with Mr. Rick Foster <br />Exhibit of required and proposed landscape calculations <br />Proposed findings of fact <br />Proposed variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff notified property owners within 350 feet of the subject <br />property of the request for variance and public hearing. <br /> <br />Observations: <br /> <br />Mr. Sacco is proposing to develop a Holiday Stationstore in River's Bend 3rd Addition at the <br />intersection of Xkimo Street N.W. and T.H. #47. City Code requires a 20 foot wide landscaped <br />yard adjacent to all public roads. However, in 1980 the City granted a 25% variance to lot sizes <br />and setbacks for all commercial uses in River's Bend. This variance was granted in lieu of <br />property dedicated for public purpose (Rum River Bridge corridor, T.H. #47 right-of-way, <br />River's Bend Park). The 20 foot landscape requirement is basically a parking lot setback. <br />Therefore, based on the City's agreement with Mr. Rick Foster in 1980, the 20 foot landscape <br />requirement adjacent to T.H. #47 in River's Bend 3ra Addition is reduced to a 15 foot' <br />requirement. <br /> <br />The right-of-way dedicated in 1980 for future improvements to T.H. #47 widens in the vicinity <br />of Xkimo and T.H. #47. As a result, the developers of the Holiday site cannot provide the 15 <br />foot landscape requirement adjacent to T.H. #47 without reducing the amount of green space that <br />is being proposed adjacent to Xkimo Street N.W. A calculation of required and proposed <br />landscaped yard has been provided by the developer and identifies that the requirement is either <br />met or exceeded along Xkimo. It is Staff's opinion that any reduction of the green space along <br />Xkimo Street is unacceptable because of the single family residential use on the east side of <br />Xkimo. In addition, there will be at least 20 feet of green space along T.H. #47. However, it will <br />be on Mn/DOT's right-of-way, not on the Holiday site. <br /> <br /> <br />
