CASE <br /> <br />REQUEST FOR A VARIANCE TO THE 4 UNITS IN 40 ACRES DENSITY <br /> RESTRICTION; CASE OF DEREK NORDVIK <br /> By: Community Development Director Sylvia Frolik . <br /> <br />Background: <br /> <br />Mr. Derek Nordvik resides on a 5 acre parcel at 15710 Armstrong Blvd. N.W, He is purchasing <br />the property on a contract for deed from his father, Donald Nordvik. Derek's mother is confined <br />to a wheelchair 75% of the time and so Donald thought that he could buy back 2.5 acres from his <br />son and build a wheelchair accessible home for he and his wife. Living next door to each other <br />would provide Derek a way to assist his dad in caring for his mother. The proposed lot split <br />would meet the 2.5 acre minimum lot size requirement, but it does not comply with the 4 units in <br />40 acres density restriction. <br /> <br />Staff informed Don and Derek that the draft comprehensive plan proposes to reduce the 4 units in <br />40 acres restriction to 1 unit per 2.5 acres and if that is approved, their proposed lot split would <br />be in compliance with the density standards. Don and Derek delayed their plans for more than a <br />year pending the outcome of the comprehensive plan. Last month they indicated that they could <br />not wait any longer and submitted an application for a variance to the 4 in 40 restriction. That <br />same week, Donald Nordvik passed away suddenly and Derek has chosen to proceed with the <br />variance request and plan to build a home for his mother on the northerly half of his property. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br /> <br />Site location map <br />Proposed lot split <br />Signed hearing notice from resident at 15620 Armstrong Blvd. supporting request <br />Section 9.03.05 of City Code regarding Variances <br />Proposed findings of fact <br />Proposed variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff notified property owners within 350 feet of the subject <br />property of the request for variance and public hearing. <br /> <br />Observations: <br /> <br />The average size of the lots north of the Subject Property is .9 acres; the lots to the west and <br />south are approximately 2.3 acres in size. Part of the reason the draft comprehensive plan <br />proposes to reduce the density to 1 unit per 2.5 acres in this area is because the development that <br />occurred prior to 1990 already exceeded 4 units in 40 acres and therefore it is not a realistic <br />standard to be achieved. <br /> <br /> <br />
