9.26.04 <br /> <br />Developing and maintaining a program to educate the public about the <br />numerous benefits and features that wetlands provide and the adverse <br />effects of improperly managed urban development on wetlands. <br /> <br />General Provisions. <br /> <br />Subd. 1. Identification and Delineation of Wetlands. <br /> <br />ao <br /> <br />This Section shall apply to all land containing wetlands and land within <br />the setback and buffer areas as defined herein. Wetlands shall be subject to <br />the requirements established herein, as well as restrictions and <br />requirements established by other applicable Federal, State, and Local <br />regulations. These wetland protection regulations shall not be construed to <br />allow anything otherwise prohibited in the zoning district where the <br />wetland area is located. <br /> <br />A wetland is land that meets the definition of "wetlands" set forth in <br />Section 9.02 of this Chapter. It is the responsibility of an applicant to <br />delineate the wetland boundary or to determine that no wetland exists on a <br />subject property. All delineations must be approved by the LGU. <br />Wetland delineations supplied by applicants shall be certified by a <br />qualified wetland delineator. Wetland delineators must satisfy any <br />certification requirements that may be established by the U.S. Army Corps <br />of Engineers or the Minnesota Board of Water and Soil Resources. <br /> <br />Wetlands have been or will be identified and the management <br />classification of the wetland, as established by the municipal wetland <br />management classification map adopted by the City Council, shall be <br />prima facie evidence of the location and management classification of a <br />wetland. The municipal wetland management classification map shall be <br />developed and maintained by the City's Community Development <br />Department and is open to inspection by the public. <br /> <br />The absence of a wetland on the municipal wetland management <br />classification map or the National Wetland Inventory does not represent a <br />definitive determination as to whether a wetland covered by this Section is <br />or is not present. Wetlands that are identified during site specific <br />delineation activities but do not appear on the municipal wetland <br />management classification map are still subject to the provisions of this <br />Section. It is the applicant's responsibility to supply detailed information <br />to determine the management classification of a wetland that does not <br />appear on the municipal wetland management classification map. The <br />municipal wetland management classification map will subsequently be <br />amended to reflect this information. <br /> <br />do <br /> <br />The four wetland management classifications established in this Section <br />are Preserve, Manage 1, Manage 2 and Manage 3 wetlands, defined as <br />follows: <br /> <br /> <br />
