/Vlayor ( ;amcc introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #05-06-168 <br />(As amended by Council Action on July 26, 2005) <br /> <br />A ilES¢)IJUTION GRANTING CONTINGENT PRELIMINARY PLAT APPROVAL OF <br />Sit AI)E TREE COTTAGES. <br /> <br /> WHEREAS, Shade Tree Communities, LLC, hereinafter referred to as "Applicant", has <br />properly applied for preliminary plat approval of Shade Tree Cottages on the following described <br />property located in the City of Ramsey: <br /> <br />All that part of the Northeast Quarter of the Northwest Quarter of Section 23, <br />lownship 32, Range 25, lying east of the easterly right-of-way of County State Aid <br />I lighway No.5, Anoka County, Minnesota. <br /> <br />(ibc "Subject Property") <br /> <br /> WHEREAS, on November 20, 2004, the City of Ramsey received an application and <br />sl<ctch plan fi'om Shade Tree Communities, LLC, for a plat to be named Shade Tree Cottages (the <br />[~lat); and <br /> <br /> WHEREAS, on January 6, 2005, the Planning Commission reviewed the sketch plan for <br />tlqe l)]al; and <br /> <br /> WHEREAS, on January 25, 2005 and February 22, 2005, the City Council reviewed the <br />sl(ctcla plan Cor the Plat; and <br /> <br /> WIIEREAS, on March 15, 2005, the Developer submitted a preliminary plat for the Plat <br />thc City/bt consideration; and <br /> <br /> WHEREAS, on April 7, 2005, the Planning Commission conducted a public hearing and <br />~'cc()mmcnclcd the City Council deny the preliminary plat of the Plat; and <br /> <br /> WHEREAS, on April 14, 2005, the Park and Recreation Commission recommended <br />park dedication and trail fees for the Plat be satisfied through a cash payment; and <br /> <br /> WHEREAS, the primary access to the Plat is to be via Potassium Street NW lying to the <br />cast of the Plat; and <br /> <br /> WHEREAS, Potassium Street is dedicated to the City by statutory dedication as a result <br />o i'it hav ing been in continuous public use and maintained by the City over a six year period; and <br /> <br /> <br />
