/Vlayor ( ;amcc introduced the following resolution and moved for its adoption: RESOLUTION #05-06-168 (As amended by Council Action on July 26, 2005) A ilES¢)IJUTION GRANTING CONTINGENT PRELIMINARY PLAT APPROVAL OF Sit AI)E TREE COTTAGES. WHEREAS, Shade Tree Communities, LLC, hereinafter referred to as "Applicant", has properly applied for preliminary plat approval of Shade Tree Cottages on the following described property located in the City of Ramsey: All that part of the Northeast Quarter of the Northwest Quarter of Section 23, lownship 32, Range 25, lying east of the easterly right-of-way of County State Aid I lighway No.5, Anoka County, Minnesota. (ibc "Subject Property") WHEREAS, on November 20, 2004, the City of Ramsey received an application and sl<ctch plan fi'om Shade Tree Communities, LLC, for a plat to be named Shade Tree Cottages (the [~lat); and WHEREAS, on January 6, 2005, the Planning Commission reviewed the sketch plan for tlqe l)]al; and WHEREAS, on January 25, 2005 and February 22, 2005, the City Council reviewed the sl(ctcla plan Cor the Plat; and WIIEREAS, on March 15, 2005, the Developer submitted a preliminary plat for the Plat thc City/bt consideration; and WHEREAS, on April 7, 2005, the Planning Commission conducted a public hearing and ~'cc()mmcnclcd the City Council deny the preliminary plat of the Plat; and WHEREAS, on April 14, 2005, the Park and Recreation Commission recommended park dedication and trail fees for the Plat be satisfied through a cash payment; and WHEREAS, the primary access to the Plat is to be via Potassium Street NW lying to the cast of the Plat; and WHEREAS, Potassium Street is dedicated to the City by statutory dedication as a result o i'it hav ing been in continuous public use and maintained by the City over a six year period; and
