<br />LG215 Lease for Lawful Gambling Activity Page ~o~
<br />
<br />Lease Term - The term of this lease agreement will be
<br />concurrent w~th the premises permit issued by the Gambling
<br />Control Board (Board).
<br />
<br />Management of Gambling Prohibited - The owner of the
<br />premises or the lessor wilt not, manage the conduct of gambling
<br />atthe premises.
<br />
<br />Participation as Players Prohibited - The lessor, the lessods
<br />immediate family, and any agent~ or gambling employees of the
<br />i lessor will not participate as players in r. he conduct of lawful
<br />gambling on the premises,
<br />
<br />]llegal Gambling
<br />· The lessor is aware of the prohibition against illegal gambling
<br /> in Minnesota $~tutes 609,75, and the penalties for illegal
<br /> gambling violations in Hinnesa~a Rules 7851.0050, Subpart 3.
<br /> In addition, the Board may authorize the organization to withhold
<br /> rent for a pedod of up to 90 days if'the Board determines that
<br /> illegal gambling occurred on the premises and that the lessor or
<br /> its employees pa~cipated in the illegal gambling Or knew of the
<br /> gambling and did not take prompt action t~ stop the gambling.
<br /> Condnued tenancy of the organization is authorized without the
<br /> payment o¢ rent during the time period determined by the Board
<br /> for violations of this provision.
<br />
<br />· To the best of the lesso~s knowledge, the lessor affirms that
<br /> any and all games or devices located on the premises are not
<br /> being used, and are not capable of being used, in a manner
<br /> that violates the prohibitions against illegal gambling in
<br /> Minnesota Statutes 609.75, and the penalties for illegal
<br /> gambling violations in Minnesota Rules 7851.0050, Subpart 3.
<br />
<br />· Not~vithst~nding Hinnesot~ Rules 7861,0050, Subpart 3, an
<br /> organization must continue malting rent payments, pursuant
<br /> to the terms of the lease, if the organization or its agents are
<br /> f~und to be solely responsible for any illegal gambling conduc'md
<br /> at t~at site that is prohibited by Minnesota Rules 786[.0050,
<br /> Subpart 1, or Minnesota Si:atutes 609.75, unless the
<br /> organization's agent~ responsible for the illegal gambling
<br /> ac~vib/are also agents or employees of the lessor.
<br />
<br />o The lessor shall not modify or terminate the lease in whole or
<br /> in part because the organization reported t~ a state or local
<br /> law enforcement authodL"y or the Board the occurrence atthe
<br /> site ofilt~al gambling activiL-y in whic~h the organization did not
<br /> pa~cipa~.
<br />
<br />Other Prohibitions
<br />· The lessor will not impose restn~ons on t~e organization with
<br /> respect to providers (distributors) of gambling-related equipment
<br /> and services or in the use of net profits for lawful purposes.
<br />
<br />. The lessor, person residing in the same household as the lessor,
<br /> the lessor's immediate family, and any agents or employees of the
<br /> le_ss~r will not require the orga nization to perform any action that
<br /> would violate statute or rule.
<br />
<br />· If there is a dispute as to whether any of these lease provisions
<br /> h~ve been violated, the lease w~ll remain in effect pending a final
<br /> determination by the Compliance Review Group (CRG) of the
<br /> Gambling Control Board.
<br />. The tenor shall not modify or terminate this lease in whole or in
<br /> part due to the lessoSs violation of the provisions listed in this
<br /> lease.
<br />
<br />Arbitration Process - The lessor agrees to arbitration when a
<br />violation of these lease provisions is a llegedt The. a. rbil:rator shall be
<br />the CRG.
<br />
<br />Access to permitted premises - The Board and its agent, the
<br />commissioners of revenue and public safety and their agent~, and
<br />lawenforcement personnel have access to the permitted premises
<br />at any reasonable time during the business hours of the lessor. The
<br />organJza~don has access to the pertained premises dunng any time
<br />reasonable and when necessary for the conduct of lawful gambling
<br />on the premises.
<br />
<br />lessor records -The lessor shall main~in a record of all money
<br />received from the organization, and make the record available to
<br />the Board and ihs agents, and the commissioners of revenue and
<br />public safety and their agent~ upon demand. The record shall be
<br />mainlined for a pedod of 3-~./2 years.
<br />
<br />Rent all-inclusive - Amounts paid as rent by the organization to
<br />the lessor are all-inclusive. No other services or expenses provided
<br />or contracted by the lessor may be paid by the organization,
<br />including but not limYced t~ trash removal, janitorial and cleaning
<br />services, snow removal, lawn services, electricity, heat, .securib/,
<br />secudW monitoring, storage, other utilities or services, and in the
<br />case of bar operadons~ cash shortages. Any other expenditures
<br />made by an organ!zation that is related to a leased premises must
<br />be approved by the director of the Gambling Conu'ol Board. Rent
<br />payments may notbe made to an individual.

<br /> Acknowledgment of Lease Terms All obligations and agreements are contained in or attached to this lease and are subject
<br /> to the approval of the direcb3r of the Gambling Control Board. ! affirm ~hat the lease informaQon is ~e total and only agreement
<br /> between the lessor and the organization. There is no other agreement and no other consideration required between the parties as to
<br /> the lawful gambling and o~er matters related to the lease. Any changes in this lease wilt be submitted to the Gambling Control Board at
<br /> least t0 days prior t~ the effective date of the change. [fa renegot~ated lease is made due to a change in ownership, the new lease will
<br /> be submitted w~hin 10 days after the new lessor has assumed ownership.
