,; <br /> <br />INTRODUCE ORDINANCE TO AMEND SECTION 9.11 <br />(PERFORMANCE STANDARDS) OF CITY CODE; <br />CASE OF CITY OF RAMSEY <br /> By: Chris Anderson, Zoning & Recycling Coordinator <br /> <br />CASE # <br /> <br />Background: <br /> <br />Earlier this year, the City received a building permit application for an exterior solid fuel-fired <br />heating device (outdoor furnace). During the review process of this application, City Staff <br />realized that there are no standards or regulations for these appliances in City Code. Due to their <br />pt~tential to create a nuisance for' neighboring properties, City Staff has drafted an ordinance tO <br />establish some basic regulations for these devices. <br /> <br />The £ollowing items are enclosed for review: <br /> a) Draft ordinance <br /> b). Planning Commission meeting minutes dated. September 1, 2005 <br /> <br />Observations: <br /> <br />The proposed ordinance would establish minimum standards for exterior solid fuel-fired heating <br />devices including both a minimum setback from property lines and installation requirements... <br />These requirements aim to minimize the potential nuisances created by these-appliances such as <br />smoke and/or cinders. <br /> <br />7he Planning Commission held a public hearing,for the proposed ordinance during their regular- <br />meeting on September 1,2005. There were no written or verbal comments submitted. However,' <br />the Planning Commission raised several concerns and directed Staff to revise the proposed <br />or'dinance accordingly. The following is a summary of the revisions that were made: <br /> <br />The word "outdoor" was replaced with the word "exterior" to eliminate any connotation <br />that these are recreational devices; <br />The definition now specifies that this is an external device used to produce heat for the <br />interior of building; <br />The definition of public nuisance was revised to conform with other Sections of City <br />Code; <br />The definition of stacks and chimneys was deleted, as there is no reference to these <br />within the text of the ordinance; <br />A minimum property size required to install a solid fuel-fired heating device was <br />eliminated, however, the setback from any property line was increased from filly (50) <br />feet to seventy-five (75) feet. The distance from a property line seemed to be the factor <br />that will contribute most to minimizing or eliminating possible nuisances to neighboring <br />properties as a result of excessive smoke and/or cinders. <br />The phrase "listed by a third party" was replaced with "listed and labeled by a nationally <br />recognized testing laboratory," for clarification purposes. <br /> <br />q <br /> <br />-285- <br /> <br /> <br />
