Assistant Community Development Director ~;rolik stated they looked at others, and also looked <br />a~ the manufacturer standards for 6utdoor solid fuel fired heating devices. · <br /> <br />Chairperson Nixt noted that in Section 9.11.14, under Stacks or Chimneys, they will want to <br />clarify, where the unit is exterior to where the heat is to be applied. <br /> <br />Commissioner Brauer noted that they may want to say "exter4or" rather than "outside". <br /> <br />Commissioner Van Scoy added that the de£mition of stacks also says any vertical structure <br />incorporated into a building; however it needs to be clear it is not incorporated in a structure. <br /> <br />C. hairperson Nixt stated that if this is a change from the public nuisance definition, they need'to <br />do that consistently throughout the code. <br /> <br />Chairperson Nixt indicated he questions the logic behind Subd. 3.a. He stated if they have size <br />and feet requirements, he is not sure why they would need to limit the acreage. He asked how <br />there could be greater risk on a one acre lot versus a' larger lot if the applicant is able to comply <br />with the size and foot requirements. <br /> <br />Assistant Community Development Director Frolik stated that there are emissions and smoke <br />issues. She indicated the thinking is that with a two-acre lot, it could dissipate before it gets to <br />ti~e neighbors. <br /> <br />Chairperson Nixt stated that even if there are two acre lots, the two homes could be located close <br />to each other. He indicated he would question limiting these to two acres. He stated he thinks a <br />one acre lot could comply. ,.. <br /> <br />Commissioner Brauer indicated that if they have lot setbacks, he questions why they need the 50 <br />fbot limitation. <br /> <br />Chairperson Nixt commented that is the same distance they have for recreational fn-es, so he can <br />understand that requirement. He stated he can understand the smoke and soot concern, but if <br />these are burning wood, it should be clean. He asked if they want a revocable Permit that can be <br />removed fbr violations. <br /> <br />Commissioner Van Scoy asked about Subd. 3.f. that says fuel-fired heating devices installed <br />within the City shall be listed by a third party, what is "third party"?. <br /> <br />ha~rp rson Nixt indicated he thinks they are saying you cannot build your own outdoor heating <br />cievice, but that should be clarified. <br /> <br />Motion by Commissioner Brauer, seconded by Commissioner Shepherd to separate the heating <br />cievice standards from the proposed ordinance and direct Staff to make the recommended <br />changes to the standards and resubmit to the Planning Commission for additional review. <br /> <br />Planning Commission/September 1, 2005 <br />Page 14 of 15 " <br /> <br />-291- <br /> <br /> <br />
