CC Regular Session 5. 19. <br /> Meeting Date: 06/14/2022 <br /> By: Chris Anderson, Community <br /> Development <br /> Information <br /> Title <br /> Adopt Resolution#22-131 Accepting Deed for Outlot A Lynwood Addition <br /> Purpose/Background: <br /> The City Council approved the Final Plat of Lynwood Addition on February 22, 2022. A condition of that approval <br /> was that the Lennar(the "Applicant")provide either a twenty(20) foot wide Trail Easement within Outlot A or <br /> deed the entirety of Outlot A to the City. One or the other is critical as the City continues to work toward a complete <br /> trail corridor connecting The COR and Lake Itasca(aka Lake Itasca Greenway). <br /> Notification: <br /> Notification is not required. <br /> Observations/Alternatives: <br /> The Applicant is proposing to deed both Outlot A and Outlot Q to the City. Outlot A is a combination of wetland <br /> and upland and will remain undisturbed throughout the construction of Lynwood Addition. Accepting fee title to <br /> Outlot A allows the City to continue working toward a complete trail/greenway corridor between The COR and <br /> Lake Itasca. Furthermore, as it will be left undisturbed, additional maintenance activities will not be required. <br /> Outlot Q,however, includes one of the main stormwater basins for Lynwood. This outlot is encumbered with <br /> drainage and utility easement. Therefore,the City will be responsible for long-term maintenance of the stormwater <br /> basin to ensure functionality,which is standard. However, if the City were to accept fee title to this outlot, the City <br /> would also have to take on more routine maintenance, such as mowing and litter/debris clean-up and removal. <br /> Presently,there is not sufficient staff capacity to take on this additional maintenance and thus, Staff is <br /> recommending only accepting fee title to Outlot A. <br /> Funding Source: <br /> The Applicant is responsible for all costs associated with this project. <br /> Recommendation: <br /> Staff recommends adopting Resolution#22-131 accepting fee title to Outlot A,Lynwood Addition. <br /> Action: <br /> Motion to adopt Resolution#22-131 accepting fee title to Outlot A, Lynwood Addition. <br /> Attachments <br /> Site Location Map <br /> Final Plat with Outlot A Highlighted <br /> Resolution#22-131 <br /> Form Review <br />
