CC Regular Session 5. 11. <br />Meeting Date: 08/08/2022 <br />By: Sean Sullivan, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #22-180 Authorizing Early Termination of Lease with Todd Bialon (EZ Auto) <br />Purpose/Background: <br />The purpose of this case is to consider adoption of Resolution #22-180 to authorize early termination of a land lease <br />with Todd Bialon. The City acquired Tax ID parcels 28-32-25-31-0020 and 28-32-25-31-0007 in 2011 utilizing the <br />Right of Way Acquisition Loan Fund (RALF) Program to secure future Right of Way for the Highway 10 project. <br />Section 2 of the attached lease, which was executed in 2018, gives either party the right to terminate the lease <br />without cause. Anoka County has commenced acquisition of parcels in the Hwy 10 Corridor for the Ramsey <br />Gateway Highway 10 Project. Anoka County has asked the city to issue a notice of termination of lease for Tax ID <br />parcels 28-32-25-31-0020 and 28-32-25-31-0007. Staff is asking the City Council to consider the early termination <br />the attached lease. <br />Notification: <br />None required <br />Observations/Alternatives: <br />The City has been working with the RALF program since 2004 to acquire properties and to hold them for future <br />Highway 10 improvements. The City has leased the above referenced property back to Todd Bialon for over 10 <br />years. The current lease with Todd Bialon gives the City the right to terminate the lease without cause as outlined in <br />Section 2. Staff is asking the City Council to consider termination of the attached lease <br />Alternatives: <br />1) Adopt Resolution #22-180 Authorizing Early Termination of Lease with Todd Bialon (EZ Auto) (as presented); <br />subject to City Attorney review <br />2) Adopt Resolution #22-180 Authorizing Early Termination of Lease with Todd Bialon (EZ Auto) (with changes); <br />subject to City Attorney review <br />3) Something else <br />Funding Source: <br />This item is being handled under normal staff duties. <br />Recommendation: <br />Staff Recommends Adoption of Resolution #22-180 Authorizing Early Termination of Lease with Todd Bialon (EZ <br />Auto) (as presented); subject to City Attorney review <br />Action: <br />Motion to Adopt Resolution #22-180 Authorizing Early Termination of Lease with Todd Bialon (EZ Auto) (as <br />presented); subject to City Attorney review <br />Attachments <br />
