<br />Mr. Fincher replied there is a draft of a shared parking and stormwater maintenance agreement <br />and encompasses snow removal, landscaping, and other things. He stated that is pending the <br />outcome of tonight before circulation to the seller. <br /> <br />City Attorney Knaak asked if they are anticipating some sort of development agreement with the <br />City. <br /> <br />Mr. Fincher replied correct. <br /> <br />City Attorney Knaak continued most of the details that are being talked about are things that get <br />finalized in the development agreement. He stated the preliminary plat and final plat are basically <br />the picture that gets filed with the City of what it is supposed to look like. Other details of where <br />drainage is going to be, what agreements are going to be required, and where the water is going to <br />go, almost all such details are almost always in a development agreement with the City. When the <br />City signs off on these things Council will get a chance to review them. He stated that is the <br />normal course on these things and he didn’t hear anyone say an exception would be made to not <br />have a development agreement. He stated the concerns will be addressed by Staff and by Council. <br />He stated he was getting the sense that the feeling is that once this is approved they won’t be able <br />to review the details, which isn’t true. <br /> <br />Councilmember Woestehoff withdrew the suggested friendly amendment because it sounded like <br />it will be included in the development agreement. <br /> <br />City Attorney Knaak asked Mayor Kuzma if anything he just said was untrue. <br /> <br />Mayor Kuzma replied no. <br /> <br />A role call vote was performed: <br /> <br />Councilmember Heineman aye <br />Councilmember Woestehoff nay <br />Councilmember Howell aye <br />Councilmember Riley nay <br />Councilmember Specht aye <br />Councilmember Musgrove aye <br />Mayor Kuzma aye <br /> <br />Motion carried. <br />7.04: Adopt Resolution #22-157 Authorizing the Issuance of Charter School Lease Revenue <br />Refunding Bonds to Finance and Refinance a Public (Charter) School Project <br />Pursuant to Minnesota Law, and Authorizing the Execution of Various Documents <br />in Connection Therewith (PACT Charter School Project) <br /> <br />Finance Director Lund stated with the current approval of the site plan and final plat PACT is <br />asking for the City to issue lease revenue bonds on their behalf.
