Acting Chairperson Gengler asked staff to speak to some of the concerns related to adjacent <br /> properties and potential liabilities as well as part of the basin being located on another plat. <br /> City Administrator Hagen commented that it is not uncommon for a stormwater basin to jump a <br /> property line. He stated that when that it is proposed, staff reviews the easement documents that <br /> would be recorded against both properties. He stated that given that the northern lot is being <br /> platted as an outlot, it is quite common for a stormwater pond to be located in an outlot. He noted <br /> that even if the outlot were replatted, the easement would remain as a permanent easement. <br /> Commissioner Hunt asked who approves the documents once the plans are finalized. <br /> City Administrator Hagen stated that the LRRWMO would review and approve the stormwater <br /> plans. He noted that those plans would be reviewed by City staff as well as Barr Engineering,who <br /> completes the engineering review for the LRRWMO. He confirmed that the people reviewing the <br /> plans are experts in those fields. <br /> Commissioner Hunt commented that he would defer to those that are experts in those fields. <br /> Commissioner Anderson asked if the church has been consulted about the shared stormwater pond <br /> and whether the potential development of the church site has been accounted for in the stormwater <br /> pond capacity as well. <br /> rr; <br /> Mr. Fincher replied that they have been in discussion with the church about the stormwater pond L <br /> as proposed and agreed with that easement. He stated that this pond is designed for the PACT site <br /> and does not account for future development on the church site. He stated that the church would <br /> go through the same process and account for runoff and stormwater management in their design <br /> as well. <br /> I <br /> Randy Bauer spoke in representation for the Church of Saint Katharine Drexel and stated that the <br /> current purchase agreement has a number of issues related to shared elements. He stated that the <br /> church has had a long relationship with PACT, even holding mass in the PACT building until their <br /> expansion was completed. He stated that there would be shared parking, utility, and stormwater <br /> pond easements as well as a trail/sidewalk connection. He commented that the church is aware <br /> that a future project on the church site would need to meet the stormwater requirements as well. <br /> He stated that the church does not have any plans for development of the north outlot. <br /> Commissioner Hunt stated that one request at the last meeting was for the developer to have more <br /> q g P <br /> interaction with the residents. He asked if that seemed productive and beneficial. <br /> Mr. Fincher replied that they did meet with residents in the neighborhood the previous week and <br /> believed that it was productive.
