<br />Councilmember Woestehoff introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #22-182 <br /> <br />RESOLUTION APPROVING A VACATION OF DRAINAGE AND UTILITY <br />EASEMENTS IN HUNT ADDITION, DAVIS FARMS ADDITION, AND TROTT <br />BROOK ADDITION <br /> <br />RECITALS <br /> <br />1. The City of Ramsey received an application from Green Valley Greenhouse, Inc. (the <br />“Property Owner”), requesting a vacation of all drainage and utility easements (the <br />“Easements”) on the properties generally known as 6530 and 6750 Green Valley Road <br />Northwest and 17455 Nowthen Boulevard Northwest and legally described, respectively, <br />as follows: <br /> <br />Lot 1, Block 1, DAVIS FARMS ADDITION, Anoka County, Minnesota <br />Lot 1, Block 1, HUNT ADDITION, Anoka County, Minnesota <br />Lot 2, Block 1, TROTT BROOK ADDITION, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />2. That the Property Owner appeared before the City Council for a public hearing pursuant to <br />Section 117-56 (Easement Vacation) of the Ramsey City Code and Section 12.6 of the City <br />Charter on August 23, 2022, and that said public hearing was properly advertised and that <br />the minutes of said public hearing are available. <br /> <br />3. That the City Council reviewed and approved the plat of DAVIS FARMS SECOND <br />ADDITION on February 22, 2022. <br /> <br />4. That the replatting of three platted parcels into two new parcels with adjusted lot lines <br />necessitate reestablishing drainage and utility easements. <br /> <br />FINDINGS OF FACT <br /> <br />1. That the partial easement vacation will not violate the intent and purpose of the <br />Comprehensive Plan. <br /> <br />2. That the easement vacation is necessary to accomplish the Permittee’s intended purpose. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the Ramsey City Council hereby grants approval of a vacation of all the Easements <br />on the Subject Property, as shown on Exhibit 1, contingent upon subsequently recording <br />the plat of DAVIS FARMS SECOND ADDITION reestablishing new drainage and <br />utility easements. <br /> <br /> <br />
