CASE # <br /> <br /> Publi~ Hearing <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW FOR MOTOR <br />VEHICLE SALES WITH AN OUTDOOR DISPLAY AREA: <br /> CASE OF LUMAX, LLC <br /> By: Breanne Dalnes, Associate Planner <br /> <br />Background: <br /> <br />The City received an application from Lumax LLC for a conditional use permit for a motor <br />vehicle sales business on the property located at 6246 Highway 10 NW. <br /> <br />The following items are enclosed for your information: <br /> a) Site location map <br /> b) Site Plan <br /> c) Proposed Findings of Fact <br /> d) Proposed resolution denying conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br />Lumax LLC is applying for a conditional use permit to sell and display vehicles for sale at the <br />property located at 6246 Highway 10 NW. The site ,is zoned E-2 Employment and guided as <br />Places to Work in the Comprehensive Plan. The proposed use is only allowed by a conditional <br />use permit within this district. <br /> <br />The applicant would like to use the unoccupied site for the sale and outdoor display of vehicles. <br />There would be approximately 10 to 15 cars on the lot. The cars would be parked on the front <br />side of~ the lot that faces Highway 10 and along the western side of the site. The existing building <br />would bt; used as a sales office. <br /> <br />City Code states that a conditional use permit can be obtained to conduct open or outdoor sales <br />as a principal use within an E~2 Employment district if the following criteria are met: <br /> [) That the use does not take up required parking spaces or loading areas and, <br /> 2) That the sales area is surfaced with asphalt or concrete material to control dust. <br /> 3) The standards on determining the suitability of granting the conditional use permit are <br /> met, per Section 9.03.05 of City Code. <br /> <br />~Ihe site is paved in accordance with a site plan submitted on November 15, 1995, and was <br />inspected on July 28, 2000. The site work was considered in accordance with the submitted site <br />plan. <br /> <br />The subject property and the surrounding areas were consciously guided for manufacturing or <br />industrial uses in the 2001 Comprehensive Plan.
