The interim final rule also permitted recipients to presume that certain services provided in <br />Qualified Census Tracts (QCTs), to individuals living in QCTs, or by Tribal governments are <br />responsive to disproportionate impacts of the pandemic. In addition to the populations presumed <br />to be impacted or disproportionately impacted, under the interim final rule, recipients could <br />identify other impacted households or classes, as described above, as well as other populations, <br />households, or geographic areas that are disproportionately impacted by the pandemic. <br />Third, as mentioned previously, the interim final rule included a non -exhaustive list of <br />uses of funds that Treasury identified as responsive to the impacts or disproportionate impacts of <br />the pandemic. Treasury refers to these as "enumerated eligible uses." <br />To summarize, the interim final rule identified certain populations that are presumed to <br />be impacted by the pandemic (and specific enumerated uses of funds that are responsive to that <br />impact) and populations that are presumed to be disproportionately impacted by the pandemic <br />(and specific enumerated uses of funds that are responsive to those disproportionate impacts). In <br />addition, the interim final rule provided standards for recipients to assess whether additional uses <br />of funds, beyond the enumerated eligible uses, are eligible for impacted and disproportionately <br />impacted populations and permitted recipients to identify other households or classes that <br />experienced impacts of the pandemic or disproportionate impacts of the pandemic. <br />Rule Structure <br />Public Comment: Many commenters expressed concern regarding the structure of the <br />eligible uses, indicating they found the structure of the public health and negative economic <br />impacts section of the interim final rule to be confusing or difficult to navigate. Other <br />commenters indicated that they understood the enumerated uses to be the only eligible uses <br />18 <br />
