organizations, including nonprofit or for -profit organizations, as subrecipients to carry out <br />eligible uses of funds on their behalf. For further information on distinguishing between <br />beneficiaries and subrecipients, as well as the impacts of the distinction on reporting and other <br />requirements, see section Transfer Process.229 <br />Reorganization and Cross -References: Under the interim final rule, assistance to <br />disproportionately impacted communities was a separate, stand-alone category. The final rule <br />reorganizes the disproportionate impact analysis within the sections Assistance to Households, <br />Assistance to Small Business, and Assistance to Nonprofits to better articulate how recipients <br />can serve disproportionately impacted beneficiaries in each of those categories. <br />As detailed above in the Public Health subsection, in response to public comments <br />describing uncertainty on which eligible use category should be used to assess different potential <br />uses of funds, Treasury has re -categorized some uses of funds in the final rule to provide greater <br />clarity. For discussion of assistance to nonprofits to implement COVID-19 mitigation and <br />prevention strategies, see section COVID-19 Mitigation and Prevention in Public Health. <br />Recipients providing assistance via nonprofits involving capital expenditures (i.e., <br />expenditures on property, facilities, or equipment) should also review the section Capital <br />Expenditures in General Provisions: Other, which describes eligibility standards for these <br />expenditures. Recipients providing assistances in the form of loans should review the section <br />Treatment of Loans. <br />229 The ARPA also states under "Transfer Authority" that a Recipient "may transfer funds to a private nonprofit <br />organization," including, but not limited to, nonprofits as that term is defined in paragraph (17) of section 401 of the <br />McKinney-Vento Homeless Assistance Act (42 U.S.C. § 11360(17). See 602 & 603 (c)(3) of the Social Security <br />Act. Title 42, Section 11360(17) defines a "Private nonprofit organization" to mean an organization "(A) no part of <br />the net earnings of which inures to the benefit of any member, founder, contributor, or individual; (B) that has a <br />voluntary board; (C) that has an accounting system, or has designated a fiscal agent in accordance with requirements <br />established by the Secretary; and (D) that practices nondiscrimination in the provision of assistance." See section <br />Transfers of Funds for additional information on other types of entities, including other forms of nonprofits, that <br />may receive transfers. <br />155 <br />
