Treasury Response: Given the large number and diversity of SLFRF recipients, Treasury <br />has aimed to include as enumerated eligible uses programs, services, and capital expenditures <br />that respond to public health and negative economic impacts of the pandemic experienced widely <br />in many jurisdictions across the country, making it clear and simple for recipients to pursue these <br />enumerated eligible uses under the final rule. This provides enumerated eligible uses that many <br />recipients may want to pursue, while including uses that are responsive to the pandemic's <br />impacts across the diverse range of SLFRF recipients. In the final rule, Treasury has clarified <br />several additional uses that generally respond to pandemic impacts experienced broadly across <br />jurisdictions and populations. <br />Treasury has not chosen to include as enumerated uses all uses proposed by commenters; <br />given the significant range, and in some cases highly specific nature, of the proposed uses <br />Treasury was not able to assess that the proposed uses would respond to negative economic <br />impacts experienced generally across the country, supporting an enumerated eligible use <br />available to all recipients presumptively. <br />However, Treasury emphasizes that the enumerated eligible uses are non -exhaustive and <br />that other uses, beyond those enumerated, are eligible. Treasury recognizes that the impacts of <br />the pandemic vary over time, by jurisdiction, and by population; as such, the final rule provides <br />flexibility for recipients to identify other public health or negative economic impacts to <br />additional households, small businesses, or nonprofits, including classes of these entities, and <br />pursue programs and services that respond to those impacts. Treasury also notes that some <br />populations are presumed to be impacted or disproportionately impacted by the pandemic, and <br />thus eligible for responsive services; these presumed eligible populations may encompass many <br />213 <br />
