DWSRF and CWSRF. Treasury emphasizes that this further clarification does not represent a <br />change in eligibility. Treasury encourages recipients to reference EPA handbooks for the <br />DWSRF and CWSRF, which provide further information and detail about the types of projects <br />eligible under those programs and thus under the final rule. <br />Eligible projects under the DWSRF. Eligibilities under the DWSRF, the interim final <br />rule, and the final rule include projects that address present or prevent future violations of health- <br />based drinking water standards. These include projects needed to maintain compliance with <br />existing national primary drinking water regulations for contaminants with acute and chronic <br />health effects. Projects to replace aging infrastructure are also eligible uses if they are needed to <br />maintain compliance or further the public health protection objectives of section 1452 of the <br />SDWA.3o9 The following project categories are eligible under the DWSRF, were eligible under <br />the interim final rule, and continue to be eligible under the final rule: <br />(i) Treatment projects, including installation or upgrade of facilities to improve the <br />quality of drinking water to comply with primary or secondary standards and point of <br />entry or central treatment under section 1401(4)(B)(i)(III) of the SDWA. <br />(ii) Transmission and distribution projects, including installation or replacement of <br />transmission and distribution pipes to improve water pressure to safe levels or to prevent <br />contamination caused by leaks or breaks in the pipes. <br />(iii) Source projects, including rehabilitation of wells or development of eligible sources <br />to replace contaminated sources. <br />309 See 42 U.S.C. 300j-12(a)(2)(B) (limiting financial assistance used by a public water system to expenditures <br />(including expenditures for planning, design, siting, and associated preconstruction activities, or for replacing or <br />rehabilitating aging treatment, storage, or distribution facilities of public water systems, but not including <br />monitoring, operation, and maintenance expenditures of a type or category which the Administrator of the EPA has <br />determined, through guidance, will facilitate compliance with national primary drinking water regulations applicable <br />to the system under 42 U.S.C. 300g-1 or otherwise significantly further the health protection objectives of the <br />SWDA); See also 40 CFR 35.3520(b). <br />274 <br />
