As discussed in the interim final rule, the offset provision does not prevent a recipient <br />government from enacting a broad variety of tax changes. Rather, the offset provision prevents a <br />recipient government from using SLFRF funds to offset a revenue reduction resulting from a tax <br />cut. A recipient government would only be considered to have used SLFRF funds to offset a <br />reduction in net tax revenue resulting from changes in law, regulation, or interpretation if, and to <br />the extent that, the recipient government could not identify sufficient funds from sources other <br />than SLFRF funds to offset the reduction in net tax revenue. Only if sufficient funds from other <br />sources cannot be identified to cover the full cost of the reduction in net tax revenue resulting <br />from changes in law, regulation, or interpretation, will the remaining amount not covered by <br />these sources be considered to have been offset by SLFRF funds, in contravention of the offset <br />provision. Consistent with the statutory text, the approach taken in the interim final rule <br />recognizes that, because money is fungible, even if SLFRF funds are not explicitly or directly <br />used to cover the costs of changes that reduce net tax revenue, those funds may be used in a <br />manner inconsistent with the statute by indirectly being used to substitute for the state's or <br />territory's funds that would otherwise have been needed to cover the costs of the reduction. As <br />discussed below, the scope of changes in law, regulation, or interpretation is further limited to <br />those that the recipient government voluntarily enacted during the covered period. <br />Congress has the authority under the Spending Clause in Article I, section 8 of the <br />Constitution to specify the permissible and impermissible uses of federal grants. The Supreme <br />Court has repeatedly "upheld Congress's authority to condition the receipt of funds on the States' <br />complying with restrictions on the use of those funds, because that is the means by which <br />320 <br />
