PROGRAM ADMINISTRATION PROVISIONS <br />The interim final rule included several sections that described the processes and <br />requirements for administering the program on an ongoing basis, specifically: distribution of <br />funds, transfer of funds, use of funds for program administration, reporting on the use of funds, <br />and remediation and recoupment of funds used for ineligible purposes. <br />To enhance clarity, this Supplementary Information for the final rule organizes these <br />issues into one section on Program Administration Provisions. Recipients should also consult <br />Treasury's Compliance and Reporting Guidance for additional information on program <br />administration processes and requirements, including the applicability of the Uniform Guidance. <br />A. PAYMENTS IN TRANCHES TO LOCAL GOVERNMENTS AND CERTAIN STATES <br />Section 602(b)(6)(A)(ii) of the Social Security Act authorizes the Secretary to withhold <br />payment of up to 50 percent of the amount allocated to each state and territory for a period of up <br />to 12 months from the date on which the state or territory provides its statutorily -required <br />372 An exception is statutes that do not apply unless explicitly stated, including, e.g., the National Environmental <br />Policy Act and the Davis -Bacon Act. <br />348 <br />
