§ 35.1 Purpose. <br />This part implements section 9901 of the American Rescue Plan Act (Subtitle M of Title <br />IX of Public Law 117-2), which amends Title VI of the Social Security Act (42 U.S.C. 801 et <br />seq.) by adding sections 602 and 603 to establish the Coronavirus State Fiscal Recovery Fund <br />and Coronavirus Local Fiscal Recovery Fund. <br />§ 35.2 Applicability. <br />This part applies to states, territories, Tribal governments, metropolitan cities, <br />nonentitlement units of local government, counties, and units of general local government that <br />accept a payment or transfer of funds made under section 602 or 603 of the Social Security Act. <br />§ 35.3 Definitions. <br />Baseline means tax revenue of the recipient for its fiscal year ending in 2019, adjusted for <br />inflation in each reporting year using the Bureau of Economic Analysis's Implicit Price Deflator <br />for the gross domestic product of the United States. <br />Capital expenditures has the same meaning given in 2 CFR 200.1. <br />County means a county, parish, or other equivalent county division (as defined by the <br />Census Bureau). <br />Covered benefits include, but are not limited to, the costs of all types of leave (vacation, <br />family -related, sick, military, bereavement, sabbatical, jury duty), employee insurance (health, <br />life, dental, vision), retirement (pensions, 401(k)), unemployment benefit plans (Federal and <br />State), workers' compensation insurance, and Federal Insurance Contributions Act taxes (which <br />includes Social Security and Medicare taxes). <br />405 <br />
