Planning Manager Larson stated that he can think of a few other situations where a parcel is split <br />zoned in town, such as the Lord of Life Church. He added that it is unusual but there is nothing <br />wrong with having a split zoned parcel. <br />Motion by Councilmember Musgrove, seconded by Councilmember Specht, to Adopt Ordinance <br />#22-24 rezoning the land between R1 MUSA 80 and R2 southeast of Green Valley Road <br />Northwest and Nowthen Boulevard Northwest and a motion to Adopt Resolution #22-183 <br />approving the final plat of Davis Farms second edition. <br />A roll call vote was performed: <br />Councilmember Musgrove aye <br />Councilmember Specht aye <br />Councilmember Riley aye <br />Councilmember Howell aye <br />Councilmember Woestehoff aye <br />Councilmember Heineman aye <br />Mayor Kuzma aye <br />Motion carried. <br />7.02: Resolution #22-208 Approving Purchase Agreement of a Portion of Outlot B, <br />Elmcrest Sanctuary, Anoka County, Minnesota (this portion of the meeting may be <br />closed to the public per MS 13D.05 Subd. 3 (c) (3)) <br />City Administrator Hagen reviewed the staff report and recommendation to move this case to <br />closed session. <br />Acting Mayor Riley asked if the Council is discussing negotiation items that would be appropriate <br />for a closed session. <br />City Administrator Hagen stated at the last closed meeting on this topic, the Council agreed to <br />general terms and directed City Attorney Knaak and himself to work with the underlying <br />landowner to put together a purchase agreement. He added that at this time there is a signed <br />purchase agreement, and the terms are largely unchanged. <br />City Attorney Knaak stated the agreement provides for a survey and the deed would have to <br />reference a survey description, which is the only outstanding issue. He added that the details and <br />terms of the agreement are locked in. He mentioned that until the agreement is agreed upon and <br />signed it remains open, which is why the possibility of further discussion open. He stated that he <br />does not recommend going into a closed session, but he wanted the Council to have the flexibility <br />if they so choose. <br />Acting Mayor Riley stated it sounds like the terms have already been agreed to and does not see <br />the need for a closed session. <br />City Council / August 23, 2022 <br />Page 6 of 16 <br />
