CANCELLATION OF LEASE <br />DATE: September 27, 2022 <br />PROPERTY ADDRESS <br />6701 Highway 10 west side - Ramsey, Minnesota 55303 <br />WHEREAS, City of Ramsey a Minnesota municipal corporation (Landlord) and Potter's House <br />Christian Community Church, Inc. a non-profit corporation organized under the laws of the <br />State of Minnesota (Tenant) have entered into a Lease Agreement dated November 24th, 2020 <br />("Lease"): <br />WHEREAS, The Tenant has been given formal notice that they are in default of the terms of <br />their Lease (A true and correct copy of which is attached hereto and incorporated herein as <br />Exhibit A) by both email and Certified Mail delivered August 31 St, 2022 at 11: 51 am to 10890 <br />133rd Circle North Champlin, Minnesota 55316. A true and correct copy of the statement given <br />to Tenant summarizing amounts of all arrearages due is attached hereto and incorporated herein <br />as Exhibit B. <br />WHEREAS, Tenant has requested Landlord defer unlawful detainer action and agree to a <br />voluntary cancellation of the Lease under mutually agreeable terms. <br />NOW THEREFORE: For good and valuable consideration the Landlord and Tenant agree to <br />the following: <br />1) Tenant admits that they are in default of the lease in the amount of $14,441.34 through <br />September 15, 2022, to include rent, utilities and snow plowing charges. <br />2) Tenant shall cease operations and remove all of their possessions by September 26th, <br />2022, at which time the Landlord will have the full right of possession to the Premises. <br />3) Tenant authorizes the Landlord to retain the Security and Damage Deposit without <br />restrictions in amount of $3,500.00 referenced in Paragraph 38 of the Lease. <br />4) Landlord has inspected the Premises and found it to be in satisfactory condition. <br />5) Each party releases the other party from any and all further obligations under the terms of <br />the Lease <br />Landlord: <br />City of Ramsey <br />Tenant: Potters House Christian <br />Community Church, Inc. <br />By: By: <br />Its: City Administrator Its: <br />Date: Date: <br />Landlord: <br />City of Ramsey <br />By: <br />Its: Mayor <br />Date: <br />
