MAINTENANCE GUARANTEE FOR LANDSCAPING. It is herein agreed that the <br /> Perm ittee shall provide a maintenance guarantee to ensure the survival of the plantings. Said <br /> maintenance guarantee shall consist of cash or a letter of credit, approved as to form by the <br /> City, in the mnount o~' $1,560 [# plantings (30 trees, 44 shrubs) x cost/planting ($100/tree, <br /> $50/shrub) x 30% average non-survival rate], which shall be in effect for a two-year period <br /> commencing on the date of the City's acceptance of said plantings as part of the Required <br /> I m provements. <br /> <br /> At thc end of' the two-year period, the maintenance guarantee shall:be, rd:turned to the Permittee. <br /> Thc determination that all plantings that have been planted in.-a~i~;ordance with the Site Plan and <br /> kandscaping Plan have either survived or have been replaced::;hhii:ibe .made by the City Council <br /> al'tot consultation with the City Engineer. In the ever/t~!':the Pe~t~ee fails to maintain the <br /> required plantings for a two-year period, the City~?.Council may $~d:~r..,the replacement of <br /> plantings with City day labor and/or by letting d0ntracts and draw";:~o.n the escrow for <br /> payment. Only the City Council shall have the authority to direct replacemen~-gfthe plantings <br /> and withdraw f~om the escrow account. The:Permittee hereby grants permissk~/i~ and a license <br /> to thc City and/or its contractors and a, ssigns to en~d~:upon:th'~'Ske for the purp~'Se of replacing <br /> plantings in the event of the Permittee s default. :'!i~ii?}?.,'" <br /> <br />~3, INSPECTION FEES. The Permittee shall be responsible-;~0,:'~_:~ll inspection costs incurred by <br /> the City related to the installation of the R.equired Improvements::: :.The Permittee shall make a <br /> cash deposit into the appropriate escrow '~iCC'bun~,at the Ci~:--hnd the City shall have the <br /> authority to draw upon these funds for'~he purp(~!~?~fcompensating for inspection services. <br /> Thc amount or' the deposit shall be equa~l-to: five pe~:~i!;:(5%) of the estimated cost of the <br /> Rcquh'ed Improvements, which equates to ($XXX). Thins is to cover the cost of inspecting the <br /> site grading and installation of improvements. Upon completion of the Improvements to the <br /> satisl~tction of the City, any surplus balance remaining in the City's escrow account shall be <br /> rct;~unded to the Permittee. <br /> <br /> ()UTSIDE REGULATORY AGENCIES.
