Motio~ by Councilmember Cook, seconded by Councilmember Pearson, to call for a public
hearing on thc subsidy agreement for Dave Perkins Contracting to be scheduled for November 7,
~005.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Pearson, Elvig, and
Strommen. Voting No: None. Absent: Councilmembers Jeffrey and Olson.

Case #4: Request for Comprehensive Plan Amendment; Case of Larry Smith

(~ommunity Development Director Trudgeon stated Larry Smith has applied for a
comprehensive plan amendment to change the land use of his property from Places to Work to
['laces to Shop. The amendment to the Comprehensive Plan would allow the applicant to
r~'dcvclop the property with commercial uses. The property is located in the northeast quadrant
o[' l;unkcr l~ake Boulevard NW and Ramsey Boulevard NW. Historically, the property has been
×oncd tbr industrial uses. Mr. Smith currently resides on the property and the residential use of
thc site is considered lawful non-conforming. The subject property is bounded on the north and
east by a single parcel that is zoned E-1 Employment. This property was recently approved for
development with self-service mini-storage units, which has not been initiated. The property to
the east is zoned R-1 Residential. The property on the west side of Ramsey Boulevard is zoned
R-2 Medium Density Residential. The property on the south side of Bunker Lake Boulevard is
zoned ['2-2 Employment and is occupied by Connexus. The property and the surrounding parcels
ar'¢ all within the Metropolitan Urban Service Area.

Mr. '['rudgcon indicated the property owner has stated that Places to Shop is more compatible
wilh thc ama and would compliment the residential developments as well as Town Center to the
south. Thc property owner could approach the City during the public process for the current
( omprchcnsive Plan Amendment underway, but has chosen to expedite matters and file the
application. There is not a site plan application in conjunction with the requested land use
change. Mr. Smith is interested in finding out if the City will approve a land use change prior to
marketing the property. He advised the Planning Commission conducted a public hearing on
October 6, 2005 and there were no written or verbal comments submitted relating to the
proposed land use change. The Planning Commission agrees that Places to Shop is more
c{m~patible with the uses in the vicinity and has recommended that City Council approve the land
u:~e change.

Motion by Councilmember Elvig, seconded by Councilmember Cook, to adopt Resolution #05-
1!)-308 approving the request and authorizing City Staff to submit the Comprehensive Plan
Amendment to Metropolitan Council for review and approval.

Ndotio~a carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Pearson, and
Strommcn. Voting No: None. Absent: Councilmembers Jeffrey and Olson.

City Council / October 25, 2005
