~ k)uncilmcmber Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-09-333 <br /> <br />A I/ESOLUTION ADOPTING FINDINGS OF FACT #0740 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM DAVID AND LYNETTE <br />RANI)AI,L TO EXCEED THE MAXIMUM ALLOWABLE SQUARE FOOTAGE FOR <br />A( T],;SS()IIY STRUCTURES AT 7960 171sT LANE NW. <br /> <br /> WltEREAS, David and Lynette Randall, hereinafter referred to as the "Applicant," have <br />properly applied tbr a Conditional Use Permit to exceed the maximum allowable square footage <br />lbr accessory structures on the property generally known as 7960 171st Lane, NW and legally <br />described as follows: <br /> <br />Ix)t 3, Block 1, DELLWOOD HILLS <br />(",'-;ubj ect Property") <br /> <br />NOW TIIEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />~:o iht request arc determined to be as follows: <br /> <br />q'hat thc Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.11.02 of the Ramsey City Code on September 1, 2005, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />?,. q'hat thc Subject Property is zoned R-l, residential and located outside the Metropolitan <br /> [ Jrbarl Service Area (MUSA). <br /> <br />3. q'hat thc Subject Property is approximately 2.3 acres in size. <br /> <br />4. q'hat City Code restricts accessory structure space to a total of 2,064 square feet for parcels <br /> 2.3 acres in size. <br /> <br />5. That thc Applicant would like to construct a 1,200 square foot building and exceed the square <br /> footage restriction by a total of 416 square feet. <br /> <br />That thc accessory building will be used to store general lawn care machinery and plowing <br />cquilm~cnt. <br /> <br />7. That the City received two letters from neighboring property owners in support of the <br /> appli cant's request. <br /> <br />b'. '/'hat lhc proposed use will not be unduly dangerous or otherwise detrimental to persons <br /> residing or working in the vicinity of the use or to the public welfare. <br /> <br />9. q'hat the proposed use will not substantially adversely impair the use, enjoyment, or market <br /> value of surrounding property. <br /> <br /> <br />
