10. <br /> <br />ll. <br /> <br />i3. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />1'7. <br /> <br />18. <br /> <br />19. <br /> <br />That the Applicant is proposing to offer 3 types of products: crushed rock, wood mulch, <br />and soil. <br /> <br />'['hat the Applicant has stated that the materials would be stored in an orderly fashion <br />within a maxi~num of twenty (20) bins with a capacity of 16 cubic yards of soil/mulch or <br />22 tons of rock each. <br /> <br />'l'hat thc proposed location for the storage of bulk landscape materials complies with the 65 <br />I'oot wide buffer around the perimeter of the Subject Property, which buffer was <br />established by the amended Conditional Use Permit approved by the City Council on <br />August 24, 2004, to serve as a buffer yard between the commercial operations and the <br />a~[jacent residential and public-right-of way. <br /> <br />'['hat the proposed use will not be unduly dangerous or detrimental to persons residing or <br />working in thc vicinity of the use, or to the public welfare. <br /> <br /> thc proposed use will not substantially adversely impair the use, enjoyment or market <br />wtluc of any surrounding property. <br /> <br />'l'hat the proposed use will be designed, constructed, operated, and maintained so as to be <br />harmonious and appropriate in appearance with the existing or intended character of the <br />general vicinity and will not change the essential character of the area. <br /> <br />That the proposed use will not be hazardous to existing or future neighboring uses. <br /> <br />That thc proposed use will not be disturbing to existing or future neighboring uses. <br /> <br />'hat the proposed use will be a substantial improvement to the property. <br /> <br />'[]]att the proposed use will be served adequately by essential public facilities and services, <br />such as highways, streets, police and fire protection. <br /> <br />'l'hat thc proposed use will not create excessive additional requirements at public cost for <br />public thcilities and services and will not be detrimental to the economic welfare of the <br />eom munity. <br /> <br />That the proposed use will not involve uses, activities and equipment that will be <br />detrimental to any persons, property, or the general welfare by reason of excessive <br />prod uction of traffic, noise, smoke, fumes, glare or odors. <br /> <br />RESOLUTION #05-09-337 <br /> Page 2 of 3 <br /> <br /> <br />
