Definitions, <br /> <br />S ubd. 1. Unless the context clearly indicates otherwise, the words, combinations of words, terms <br />and phrases, as used in Section 735:00 et seq., shall have the meanings set forth in the subdivisions <br />of this section which follow: <br /> <br />a. "Person" includes an individual, partnership, corPoration, 'the Stz/te and its agencies and <br />subd/.visions, and any body of persons, whether incorPorated or not. <br />b. "Skateboard" means a device for riding upon, usually while ,standing, consisting of an oblong: <br />piece of wood or of other composition mounted, on skate wheels. <br />c. "Roller skate" means a form of skate with small wheels or rollers instead of a runner. <br />d. "Operate" means to ride on or upon or control the operation of a skateboard or roller skates. <br />e. "Operator" means every person wt'~o operates or is in actual-physical control of a skateboard or <br />roller skates. <br /> <br />Section 735:05. Regulation of the Use of Roller Skates or Skateboards. <br /> <br />Subd. 1. It shall be unlawful for any person to operate a skateboard or roller skates under the <br />circumstances set forth in the subdivisions which follow: <br /> <br />a. On private property of another without the express permission to do so by the owner or occupant <br />of said property. <br /> <br />b. In any careless, reckless or negligent manner so as to endanger, or be likely to endanger, the <br />safety o.f any person or the property of any other person. <br /> <br />c. Upon any public street or upon any public sidewalk within the downtown area designated as an <br />area bounded on the south by Mill Street, on the west by Oak Avenue, on the north by Rose Street, <br />and on the east by Grove Avenue, and including the area of said designated streets and the <br />sidewalks parallel thereto on both sides of the street. <br /> <br />d. The operator of a skateboard or roller skates emerging from an alley, driveway or building upon <br />approaching a sidewalk or the sidewalk area extending across any alleYWay shall yield the right-of- <br />way to all pedestrians approaching the sidewalk or sidewalk area and upon entering the roadway <br />sha~ll yield the right-of-way to all vehicles approaching on the roadway. <br />e. No person operating a skateboard or roller skating shall attach the same or the person of the <br />operator to any vehicle upon a roadway. <br /> <br />26 <br /> <br /> <br />
