<br />City Administrator Hagen said the easiest solution was for the Charter to introduce this to the <br />Council, Council would need to act on it, and if it is unanimously accepted it would go into effect <br />after a referendum to the voters. If it is adopted right now, it goes to the Charter and then it would <br />come back to Council to decide official language and ballot question language. He noted it is too <br />late for this to go on this year’s election. <br /> <br />Councilmember Howell asked if, since there is a policy in place, an application could be sent to <br />the judge to sit on the Charter. <br /> <br />City Administrator Hagen said, technically, yes. <br /> <br />Councilmember Howell asked if this is urgent to get on the ballot if passed. <br /> <br />City Attorney Knaak stated it is up to the Council how this is handled. <br /> <br />Councilmember Woestehoff asked if the Council is bound by any timeline that says it has to be to <br />the voters by a certain time. <br /> <br />City Attorney Knaak stated he does not believe there is a timeline. <br /> <br />Councilmember Woestehoff asked if Charter Commission could be compelled to take this up first <br />then Council will address it. <br /> <br />Councilmember Woestehoff withdrew his motion. <br /> <br />Councilmember Musgrove asked what the process would be to get this to the Charter Commission. <br /> <br />City Administrator Hagen said he could find a way to point out to the Charter Commission that <br />Council is encouraging this. If nothing is done and the Council does not seek a fast special election <br />there would be time. <br /> <br />Councilmember Heineman asked if the Charter Commission initiated this and the Council voted, <br />would this still go out as a referendum. <br /> <br />City Attorney Knaak said it is done and is enacted after 90 days, which is in a way a loophole. <br /> <br />Councilmember Heineman asked if this does not call for a special election if it would not cost <br />anything since it would be added to a preexisting ballot. <br /> <br />City Attorney Knaak said that was correct. <br /> <br />Councilmember Heineman did not want to rush this decision and wanted to get this in front of <br />voters. <br /> <br />Councilmember Specht agreed that the people could decide since there is no timeline. <br /> <br />City Council / October 11, 2022 <br />Page 9 of 13 <br /> <br /> <br />
