CASE # Z <br />Public Hearing <br />CONSIDER ORDINANCE TO VACATE <br />DRAINAGE AND UTILITY EASEMENT IN CLEMENS ADDITION: <br />CASE OF VINCENT CLEMENS <br />By: Breanne Dalnes, Associate Planner <br />Background: <br />Vincent Clemens has submitted an application for a minor plat to convert Outlot A of Clemens <br />Addition into one buildable lot to be called, Lot 1 Block 1, Clemens Second Addition. A <br />drainage and utility easement vacation is necessary because the outlot was platted with drainage <br />and utility easements, and the lot line is changing slightly. The purpose of the requested <br />easement vacation is to avoid a larger easement than necessary. A new easement will be <br />established around the perimeter of the newly buildable lot as part of the replat of Outlot A. <br />The following items are enclosed for your information: <br />a) Site location map <br />b) Exhibit of underlying easements to be vacated <br />c) Final Plat of Clemens Second Addition <br />d) Proposed ordinance <br />to(Notification: <br />In accordance with State Statue, property owners within 350 feet of the subject property were <br />notified of this hearing. <br />Observations: <br />A public hearing and ordinance adoption is required in order to vacate easements. <br />recommendation: <br />City Staff recommends introduction of the enclosed ordinance to vacate the existing easements. <br />Council Action: <br />iviotion to introduce Ordinance #05-— <br />to vacate the easements for drainage and utility purposes <br />for the area legally described as "the drainage and utility easement along the common lot line <br />between Lot 1, Block 1 and Outlot A, as dedicated on the recorded plat of Clemens Addition, <br />Anoka County, Minnesota, EXCEPT the west 10 feet and also EXCEPTING the east 5 feet. <br />R.evicri, Checklist: <br />A.s . i.stant Community Development Director <br />Cavil Ent neer <br />CC: 1 1 /22/05 <br />—149— <br />
