CASE # 3 <br />REQUEST FOR FINAL PLAT REVII✓ V OF CLEMENS SECOND ADDITION: <br />CASE OF VINCENT CLEMENS <br />By: Breanne Dalnes, Associate Planner <br />Background: <br />Vincent and Evelyn Clemens are proposing a minor subdivision to convert one existing outlot <br />into one buildable lot generally located at the corner of Ebony Street and 137`h Avenue NW. <br />The following items are enclosed for your information: <br />a) Site location map <br />b) Proposed minor subdivision exhibit <br />c) Planning Commission minutes dated November 3, 2005 <br />d) City Staff Review Letter dated October 25, 2005, revised November 18, 2005 <br />e) Proposed Development Agreement for Clemens Second Addition <br />f) Proposed Resolution for final plat approval <br />Notification: <br />Minor subdivisions are not subject to a public hearing. However, owners of property within 700 <br />40 feet of the subject property were notified of the sketch plan. A land use sign was also erected on <br />the subject property. <br />Observations: <br />The subject property is zoned R-1 MUSA and lies within the Critical Overlay District for the <br />Mississippi River. The proposed lot will be 16,240 square feet in size, which exceeds the <br />minimum lot size of 12,150 square feet, and conforms to the minimum lot width of 90 feet. <br />Access to the proposed lot will be gained from Ebony Street. Sewer and water facilities recently <br />became available to Outlot A of Clemens Addition and the lot will hook up_ to these facilities <br />located in Ebony Street. <br />As pare of this application, the applicant has submitted a request for a vacation of easement, due <br />to the minor shift in the southern property line. This shift was recommended by staff, in order to <br />avoid luture conflict regarding the property lines. <br />The Planning Commission heard the request for sketch plan review on November 2, 2005, and <br />had no additional comments or concerns. <br />Recommendation: <br />Staff recommends that the City Council approve the request to replat Outlot A of Clemens <br />Addition to Lot 1, Block 1, Clemens Second Addition. <br />—155— <br />
