CASE # 3 REQUEST FOR FINAL PLAT REVII✓ V OF CLEMENS SECOND ADDITION: CASE OF VINCENT CLEMENS By: Breanne Dalnes, Associate Planner Background: Vincent and Evelyn Clemens are proposing a minor subdivision to convert one existing outlot into one buildable lot generally located at the corner of Ebony Street and 137`h Avenue NW. The following items are enclosed for your information: a) Site location map b) Proposed minor subdivision exhibit c) Planning Commission minutes dated November 3, 2005 d) City Staff Review Letter dated October 25, 2005, revised November 18, 2005 e) Proposed Development Agreement for Clemens Second Addition f) Proposed Resolution for final plat approval Notification: Minor subdivisions are not subject to a public hearing. However, owners of property within 700 40 feet of the subject property were notified of the sketch plan. A land use sign was also erected on the subject property. Observations: The subject property is zoned R-1 MUSA and lies within the Critical Overlay District for the Mississippi River. The proposed lot will be 16,240 square feet in size, which exceeds the minimum lot size of 12,150 square feet, and conforms to the minimum lot width of 90 feet. Access to the proposed lot will be gained from Ebony Street. Sewer and water facilities recently became available to Outlot A of Clemens Addition and the lot will hook up_ to these facilities located in Ebony Street. As pare of this application, the applicant has submitted a request for a vacation of easement, due to the minor shift in the southern property line. This shift was recommended by staff, in order to avoid luture conflict regarding the property lines. The Planning Commission heard the request for sketch plan review on November 2, 2005, and had no additional comments or concerns. Recommendation: Staff recommends that the City Council approve the request to replat Outlot A of Clemens Addition to Lot 1, Block 1, Clemens Second Addition. —155—
