Councilmember XXXX introduced the following resolution and moved for its adoption: RESOLUTION 405-11- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FROM LUMAX LLC TO ALLOW FOR MOTOR VEHCILE SALES WITH OUTDOOR DISPLAY IN THE E-1 EMPLOYMENT DISTRICT WHEREAS, Lumax LLC, hereinafter referred to as the "Applicant," have properly applied fora Conditional Use Permit to sell and display vehicles on the property generally known as 6246 Highway 10 NW and legally described as follows: Lot 10, AUD. SUB. NUMBER 96 4 ("Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS, CITY COUNCIL OF THE CITY OF R4!MSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 1. The Planning Commission conducted a public hearing -pursuant to Section 9.03.05 of the Ramsey City Code on November 33,, 2005, and that 'said , public hearing was properly advertised and that the minutes of said public hearing are hereby. ,incorporated by reference, and that the applicant was not present at.the public hearing 2. That the Subject Property. is zoned E-1 Employment. 3. That the Subject Property is approximately .44 4cres in size. 4. That City Code restricts outdoor sales as a principal use, and requires a conditional use permit within the E- I District. 5. That the Applicant would like to>sell and display vehicles outdoors on the property within the E- IDistrict. 6. That the surrounding properties are a mixture of manufacturing and retail, auto -related uses. 7. That the City Council: made a conscious decision to transition the Subject Property and surrounding parcels from places to shop to places to work in the 2001 Comprehensive Plan. S. That the proposed use will not be unduly dangerous or otherwise detrimental to persons residing or working in the vicinity of the use or to the public welfare. That the proposed use will not substantially adversely impair the use, enjoyment, or market value of any surrounding property. • 10. That the proposed use will not be hazardous or disturbing to existing neighboring uses.
