Councilmember XXXX introduced the following resolution and moved for its adoption: <br />RESOLUTION 405-11- <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST <br />FROM LUMAX LLC TO ALLOW FOR MOTOR VEHCILE SALES WITH OUTDOOR <br />DISPLAY IN THE E-1 EMPLOYMENT DISTRICT <br />WHEREAS, Lumax LLC, hereinafter referred to as the "Applicant," have properly <br />applied fora Conditional Use Permit to sell and display vehicles on the property generally known <br />as 6246 Highway 10 NW and legally described as follows: <br />Lot 10, AUD. SUB. NUMBER 96 <br />4 <br />("Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THIS, CITY COUNCIL OF THE CITY OF <br />R4!MSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. The Planning Commission conducted a public hearing -pursuant to Section 9.03.05 of the <br />Ramsey City Code on November 33,, 2005, and that 'said , public hearing was properly <br />advertised and that the minutes of said public hearing are hereby. ,incorporated by reference, <br />and that the applicant was not present at.the public hearing <br />2. That the Subject Property. is zoned E-1 Employment. <br />3. That the Subject Property is approximately .44 4cres in size. <br />4. That City Code restricts outdoor sales as a principal use, and requires a conditional use <br />permit within the E- I District. <br />5. That the Applicant would like to>sell and display vehicles outdoors on the property within the <br />E- IDistrict. <br />6. That the surrounding properties are a mixture of manufacturing and retail, auto -related uses. <br />7. That the City Council: made a conscious decision to transition the Subject Property and <br />surrounding parcels from places to shop to places to work in the 2001 Comprehensive Plan. <br />S. That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br />That the proposed use will not substantially adversely impair the use, enjoyment, or market <br />value of any surrounding property. • <br />10. That the proposed use will not be hazardous or disturbing to existing neighboring uses. <br />
